The Town of Westminster (OWNER) will be accepting SEALED BIDS for FY2026Road Improvement Pro- gram. The work involvesroad pavement work to be funded under the MassDOT Chapter 90 program as well as with town appropriations. Work willinclude Asphalt Cold Planing, Bituminous Con- crete Paving, Pavement Reclaiming and Grading, and other pavement relatedwork. Bids shall be on a Unit Price basis. Quantities shown on the Bid Form are approximate only and will be used forcomparison of bids and to set the amount of the Bid Deposit. The contract award will be dependent on available funding. Thebidding and award of this Contract will be under the provisions of M.G.L. Chapter 30, Section 39M. Complete instructions forfiling Bids are included in the Instructions to Bidders. Each General Bid shall be accompanied by a Bid Security (certified, treasurer's or cashier's check or bid bond) in the sum of five (5) percent of the Total Bid is required. MassDOT prequalification of contractors with the class of work as, Pavement Surfacing, for the project with an estimated value of $1,374,695 will berequired. No Bidder may withdraw his Bid for a period of sixty (60) days, excluding Saturdays, Sundays, and legal holidaysafter the actual date of the opening of the General Bids. This advertisement does not obligate the Owner for any costsassociated with preparing or submitting bids. The successful bidder(s) must furnish a 100 percent Performance Bond and a100 percent Payment Bond with a surety company acceptable to the Owner. Minimum wage rates as determined by theCommissioner of Department of Workforce Development under the provisions of M.G.L., Chapter 149, Section 26 to 27D,inclusive, as amended, apply to this project. It is the responsibility of the contractor, before bid opening, to request ifnecessary, any additional information on Prevailing Wage Rates for those trades people who may be employed for theproposed work under this contract. The Owner, being considered the sole and only judge, reserves the right to waive anyinformality in, or to reject, any or all Bids, should the Owner deem it to be in the owner's best interest to do so.
