The successful bidder will be required to furnish bonds as follows: (1) Performance Bond in a sum equal to one hundred (100%) percent of the full annual amount of the contract, and (2) Labor and Material Bond in a sum equal to one hundred (100%) percent of the full annual amount of the contract. For the basis of the bond, the contractor is to assume approximately 6,500 tons of garbage per year to be landfilled. Such Performance Bond and Labor and Material Bond must be furnished by the successful bidder simultaneously with the delivery of the executed contract by such bidder. Furthermore, the successful bidder must provide the municipalities with Certificates of Insurance as required by the Contract Documents and an AIA form G703, complete in sufficient detail for this project. Each bidder must submit with its proposal a "Business Registration Certificate" (Form BRC (08-01) as stated in C57, Laws of 2004, S1778, N.J. Department of Treasury/Division of Revenue 609-292-1730. This form MUST be provided at the time of the bid proposal. FAILURE TO DO SO IS A FATAL NONCURABLE DEFECT IN THE BID PROPOSAL. THERE IS NO EXCEPTION. Bidders are required to comply with the requirements of P.L. 1975, c. 127, regarding Affirmative Action, Executive Order 11246 regarding Equal Employment Opportunity, and Chapter 33, P.L. 1977 regarding disclosure of Partners and Stockholders, Davis Bacon Act of 1963, Chapter 153, (R.S. 11- 56.25 et seq.) regarding Prevailing Wage Act, including employee wages and benefits. Bidders must also supply a W-9 form. The Mayor and Council reserve the right to waive any informalities or to reject any and all bids.
