Site work and paving for a mixed-use development in Madera, California. Completed plans call for site work for a sidewalk / parking lot; and for paving for a sidewalk / parking lot.
Sealed bids will be received at the office of the City Engineer of the City of Madera for the following: Community and Park Facilities Parking Lot Surface Rehabilitation, City Project No. Pk-81 CDBG Block Grant The work in general consists of performing surface treatments, pavement rehabilitation, and pavement markings and striping for City parking lots. The work will also include grinding and removing deteriorated asphalt pavement, applying hot mix asphalt dike, and applying fog sealing, micro-surfacing, crack seal, and filling in potholes to improve the overall pavement condition and extend its service life. In accordance with the provisions of Section 3300 of the Public Contract, the general contractor for this project shall have a Class A, C-12, or C-32 California State Contractor's License issued in accordance with the provisions of the Contractor's State License Law, California Business and Professions Code, Division 5, Chapter 9, as amended. All contractors and subcontractors that wish to bid on, be listed in a bid proposal, or enter into a contract to perform public work must be registered with the Department of Industrial Relations. No bid will be accepted nor any contract entered into without proof of the contractor's and subcontractors' current registration with the Department of Industrial Relations to perform public work. If awarded a contract, the bidder and its subcontractor(s), of any tier, shall maintain active registration with the Department of Industrial Relations for the duration of the project. This project is being financed with Community Development Block Grant funds from the U.S. Department of Housing and Urban Development (24 CFR Part 570) and subject to certain requirements including: compliance with Section 3 (24 CFR Part 135) Economic Opportunities requirements; payment of Federal Davis-Bacon prevailing wages; Federal Labor Standards Provisions (HUD 4010); Executive Order #11246; and others. Section 3 requires that to the greatest extent feasible opportunities for training and employment be given to low and very low income persons residing within the project area and that the contracts for the work in connection with the project be awarded to eligible business concerns which are located in, or owned in substantial part by persons residing in the area of the project. Regulations for implementing the Section 3 clause are contained in 24 CFR 135, as amended, as specified in the project specifications along with information pertaining to the other Federal requirements. The City of Madera hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, Disadvantaged Business Enterprise (DBE), Minority Business Enterprise, and Women-Owned Business Enterprise will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award. Federal minimum wage rates are available from the Department of Labor Home Page at online. If there is a difference between the federal minimum wage rates and the prevailing wage rates determined by the Director of Industrial Relations of the State of California for similar classifications of labor, the Contractor and subcontractors shall pay not less than the higher wage rate. Ten days prior to bid opening, the City will check whether updated federal wage rates have been posted. If updated wage rates have been posted, City will issue an addendum notifying plan holders of the change. The final contract signed by the City and the Contractor will physically contain the federal wage rates as they exist on the tenth day prior to bid opening. Bid security in the amount of ten (10) percent of the amount of the bid, and in the form of a bid bond issued by an admitted surety insurer licensed by the California Department of Insurance, cash, cashier's check or certified check shall accompany the bids. Bid securities shall be made in favor of the City of Madera. In accordance with the provisions of Division 2, Part 5, Section 22300 of the Public Contract Code of the State of California, securities may be substituted for non-federal monies withheld on this Project. In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pension, vacation, travel time and subsistence pay as provided by Section 1773.8 apprenticeship or other training programs authorized by Section 3093, and similar purposes applicable to the work to be done. These wage rates are on file with the City Engineer, City of Madera, and are incorporated herein by reference. This agreement is for services related to a project that is subject to the Build America, Buy America Act (BABAA) requirements under Title IX of the Infrastructure Investment and Jobs Act ("IIJA"), Pub. L. 177-58. Absent an approved waiver, all iron, steel, manufactured products, and construction materials used in this project must be produced in the United States, as further outlined by the Office of Management and Budget's Memorandum M-22-11, Initial Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure, April 18,2022. The City Council of the City of Madera reserves the right to reject any and all bids, and to waive any and all irregularities in any bid.
