The successful bidder shall furnish the following: (1) a good and sufficient surety bond or irrevocable letter of credit in the amount of the contract sum complying with the provisions of section 1 of title 61, of the oklahoma statutes (payment bond) and (2) a surety bond or irrevocable letter of credit issued by a financial institution insured by the federal deposit insurance corporation or the federal savings and loan insurance corporation in the amount of the contract sum, to ensure the proper and prompt completion of the work in accordance with the provisions of the contract and bidding documents (performance bond); and (3) a surety bond or an irrevocable letter of credit in the amount of contract sum to protect the owner against defective workmanship and materials for a period of one (1) year after acceptance of the project (warranty bond); and (4) public liability and workers compensation insurance during the construction in reasonable amounts as determined by owner. Irrevocable letters of credit for any of the foregoing must be issued by a financial institution having an office in the state of oklahoma and insured by the federal deposit insurance corporation or the federal savings and loan insurance corporation. The foregoing bonds and insurance must be provided within ten (10) business days after the contract has been awarded by owner, unless the time for furnishing the above bonds is extended by owner in writing. In any event, no work order will be issued and the contractor shall not be permitted to commence work on the project until the foregoing has been furnished to owner. Bids received more than twenty-four (24) hours, excluding saturdays, sundays, and holidays, before the time set for opening of bids, as well as bids received after the time set for opening of bids, will not be considered and will be returned unopened. No bidder can withdraw his bid after the opening date. Attention is called to the fact that a designated completion date for this project has been set for september 1, 2026. There will be a $500.00 per day liquidated damages clause in the contract for the project. The scheduled completion date is the date on which the contractor receives a certificate of substantial completion. Bids shall be accompanied by a bid security in the amount of 5 percent (5%) of the bid if the bid equals or exceeds $100,000.00. By this notice, all provisions of the act apply to this project and are incorporated into notice by reference. The bid security is a guaranty that the successful bidder will enter into a contract with the owner for the completion of the city of sapulpa - sapulpa fire department training facility. The bid security will be paid to owner as reasonable liquidated damages if the successful bidder fails, neglects or refuses to enter into the contract. Owner reserves the right to reject any or all bids or portions of bids and to waive informalities or minor irregularities in any bid.
