The Owner Reserves the Right to Reject Any or All Prequalification and/or Proposals, Waive Technical Errors, and/or Abandon This Process if, in Their Judgment, the Owner's Best Interests Will Be Promoted. The Bidder Shall File With His Bid Either a Cashier's Check Drawn on an Alabama Bank, Payable to the City of Gadsden, Alabama, or a Bid Bond Executed by a Surety Company Duly Authorized and Qualified to Make Such Bonds in Alabama, in an Amount Equal to the Lesser of Five Percent (5%) of the Bid or Ten Thousand ($10,000). The Owner Reserves the Right to Waive Any Informalities or to Reject Any and All Bids. Attendance at the Pre-bid Conference is Not Required but Highly Recommended for All Prime Contractor Bidders (and Any Subcontractors) Intending to Submit a Proposal. This is a Tax-exempt Contract. By Signing This Contract, the Contracting Parties Affirm, for the Duration of the Agreement, That They Will Not Violate Federal Immigration Law or Knowingly Employ, Hire for Employment, or Continue to Employ an Unauthorized Alien Within the State of Alabama. Furthermore, a Contracting Party Found to Be in Violation of This Provision Shall Be Deemed in Breach of the Agreement and Shall Be Responsible for All Damages Resulting Therefrom. Bidders Must Certify That They Do Not and Will Not Maintain or Provide for Their Employees Any Facilities That Are Segregated on a Basis of Race Creed, Color, Sex, or National Origin.
