**As of November 13, 2025 no bids reecived or this project.** The County of Kern (County) will receive sealed Bids for construction on a highway in accordance with the plans and special provisions therefor to which special reference is made as follows: FOR CONSTRUCTION OF SOUTH SHAFTER SEPTIC SYSTEM IMPROVEMENTS No bid will be considered unless it is made on a Bid form furnished by the County's Public Works Department (Department) and accompanied by bidder's security in an amount equal to 10% of the amount bid in accordance with the provisions set forth under Section 2, "Bidding," of the Standard Specifications of the State of California Department of Transportation, dated 2024, as modified by the special provisions. The successful bidder must complete the work, including plant establishment work, within 95 working days. The County reserves the right to reject any and all bids. If the contract is to be awarded, it will be awarded by the Board of Supervisors to the lowest responsible bidder whose bid complies with all prescribed requirements. The successful bidder must furnish a Performance Bond and a Payment Bond each in the amount of 100% of the contract price and on the County's form. Pursuant to Public Contract Code Section 22300, the substitution of securities for money withheld by Kern County to ensure performance of the contract will be permitted. All documents submitted in compliance with the requirements of this bid package and the contract must be scannable and photocopiable. Each bidder must be licensed as required by law at the time the contract is awarded. Failure of the bidder to obtain proper and adequate licensing for an award of a contract shall constitute a failure to execute the contract and shall result in the forfeiture of the security of the bidder. The contractor license classification required for this project is: A, B, C-36 or C-42. This contract is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code Section 12990. No discrimination shall be made in the employment of persons for this project. Labor Code Section 1735 and all other applicable State and Federal requirements relating to employment discrimination shall be complied with. Pursuant to the provisions of Labor Code Section 1771.1, a contractor or subcontractor shall not be qualified to bid on, be listed in a Bid, subject to the requirements of Section 4104 of the Public Contract Code, or engage in the performance of any contract for public work, as defined in Chapter 1 of Part 7 of Division 2 of the California Labor Code, unless currently registered and qualified to perform public work pursuant to Civil Code Section 1725.5. Please note: It is not a violation of Section 1771.1 for an unregistered contractor to submit a bid that is authorized by Section 7029.1 of the Business and Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded. Any bids submitted without proof that Bidder and any listed subcontractor(s) are currently registered and qualified to perform public work, pursuant to Labor Code Section 1725.5, shall not be accepted by the County. County shall not accept a Bid from a Bidder who is ineligible to bid or work on, or be awarded, a public works project pursuant to Labor Code Section 1777.1 or Xllll. No bidder shall include in its Bid any subcontractor who is ineligible to bid or work on, or be awarded, a public works project pursuant to Labor Code Section 1777.1 or 1777.7. Each bidder is hereby informed that, upon submittal of its Bid to the County, the Bid is the property of the County. The County shall consider each Bid subject to the public disclosure requirements of the Public Records Act (Government Code section 6250, et seq.) after Bid opening, unless there is a legal exception to public disclosure. County specifically reserves the right, in its sole discretion, to reject any or all Bids, or re-bid, or to waive inconsequential deviations from Bid requirements not involving time, price, or quality of the work. This project is federally funded in whole or part. Minimum wage rates for this project as predetermined by the United States Secretary of Labor are set forth in the Special Provisions and may be obtained online. Pursuant to Part 7 of Division 2 of the California Labor Code (Section 1720 et seq.) the Contractor shall not pay less than the prevailing rate of wages to workers on this project as determined by the Director of California Department of Industrial Relations. The Director's schedule of prevailing rates is on file and open for inspection at the Kern County Public Works Department, or may be obtained online. If there is a difference between the minimum wage rates predetermined by the United States Secretary of Labor and the prevailing wage rates predetermined by the Director of the California Department of Industrial Relations for similar classifications of labor, the Contractor and all subcontractors shall pay not less than the higher wage rate. The Department will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes "helper" (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise available for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the Federal minimum wage rate which most closely approximates the duties of the employees in question. The contract will be under and subject to Executive Order 11246 of September 24,1965, as amended, the Equal Employment Opportunity and Federal Labor Provisions and with all other applicable requirements of HUD and Kern County, including but not limited to, prevailing wage rate and affirmative action requirements for equal employment opportunity as explained in the contract documents. The bidder will be required to submit with the Bid Proposal the Appendix C "Affirmative Action Plan" contained in the documents for this project. This Community Development Project is subject to the Davis-Bacon Act, the Copeland "Anti-Kick Back" Act, the Equal Employment Opportunity Requirements and the Contract Work Hours and Safety Standards Act. All insurance (other than Workers Compensation/Employers' Liability) shall be issued by a company or companies admitted to do business in California and listed in the current "Best's Key Rating Guide" publication with a minimum of an A-, VII rating or in special circumstances, issuers preapproved by both the Risk Management Division of the Office of County Counsel and the Public Works Department at least 5 business days prior to bid opening. On March 4, 2022, Governor Gavin Newsom issued Executive Order N-6-22 (the EO) regarding Economic Sanctions against Russia and Russian entities and individuals. "Economic Sanctions" refers to sanctions imposed by the U.S. government in response to Russia's actions in Ukraine, as well as any sanctions imposed under state law. By submitting a bid or proposal, Contractor represents that it is not a target of Economic Sanctions. Should the State determine Contractor is a target of Economic Sanctions or is conducting prohibited transactions with sanctioned individuals or entities, that shall be grounds for rejection of the Contractor's bid/proposal any time prior to contract execution, or, if determined after contract execution, shall be grounds for termination by the State. The bidder to whom the contract is awarded will be required to comply with the Small Business Affirmative Action Plan requirements as set forth in the special provisions. Section 3 Requirements: The work to be done on this project is subject to the provisions of Section 3 of the Housing and Urban Development Act of 1968 (which requires that employment and other economic opportunities generated by certain HUD financial assistance shall, to the greatest extent feasible, and consistent with the existing Federal, State and local laws, be directed to low- and very low-income persons, particularly those who are recipients of government assistance for housing, and to business concerns which provide economic opportunities to low- and very low-income persons. These requirements are explained in detail at 24 CFR Part 75. The pre-bid conference will include a workshop on Section 3 compliance.
