2 Project Description: A Job Order Contract ("JOC") is a competitively bid, firm fixed priced indefinite quantity contract. It includes a collection of detailed repair and construction tasks and specifications that have established Unit Prices. It is placed with a Contractor for the accomplishment of repair, alteration, modernization, maintenance, rehabilitation, construction, etc., of buildings, structures, or other real property. Ordering is accomplished by the issuance of a Job Order against the Contract. The Contractor, under the JOC contract, furnishes all management, labor, materials, and equipment needed to perform the work. The County anticipates awarding one contract under this solicitation. The County reserves the right to award more than one contract under this solicitation. The JOC award under this solicitation will have no minimum value, and an initial maximum value of $1,000,000. The term of the contract will be for one year or expenditure of the $1,000,000 initial maximum value of the contract, whichever occurs first. Upon mutual agreement, the maximum value of the contract may be increased at any time during the term of the contract and for any amount, except that the aggregate contract amount may not exceed the maximum value established by PCC 20128.5. Job Orders will be issued based on contractor performance, contractor's ability to properly execute the workload, and the availability of funded or approved projects. The number, dollar value, and sequence of Job Order issuance is solely at the discretion of the County. The OWNER selected The Gordian Group's (Gordian) Job Order Contracting (JOC) Solution fortheir JOC program. The Gordian JOC SolutionTM includes Gordian's proprietary JOC Information Management System ("JOC IMS"), JOC Applications, construction cost data, and Construction Task Catalog which shall be used by the Contractor solely for the purpose of fulfilling its obligations under this Contract, including the preparation and submission of Job Order Proposals, Price Proposals, subcontractor lists, and other requirements specified by the Owner. The Contractor shall be required to execute Gordians SaaS Terms of Use and pay a JOC System License Fee to obtain access to the Gordian JOC SolutionTM. The JOC System License Fee applies to all Job Orders issued to the Contractor under the terms of the Contract. The JOC System License Fee shall be equal to 1 % of the Job Order Price. Each bidder must submit two sets of price Adjustment Factors to be considered responsive. These same Adjustment Factors must apply to all work tasks listed in the Construction Task Catalog of the contract documents. The first set of Adjustment Factors will be for projects within Region 1 and the second will be for projects within Region 2. Each set of Adjustment Factors will consist of two factors. The first Adjustment Factor will be applied to work to be accomplished during Normal Working Hours. The second Adjustment Factor will be applied to work accomplished during Other Than Normal Working Hours. No bid will be considered unless it is made on a Bid Proposal form furnished by the County of Kern. The substitution of securities for money withheld by Kern County to ensure performance of the contract is permitted under Public Contracts Code Section 22300.1.04 Instructions: Bidders shall refer to Document 00 200 Instructions to Bidders for required documents and items to be submitted in a sealed envelope. 1.06 Bid Preparation Cost: Bidders are solely responsible for the cost of preparing their Bids. 1.07 Reservation of Rights: Owner specifically reserves the right, in its sole discretion, to reject any or all Bids, to re-bid, or to waive inconsequential defects in bidding not involving time, price or quality of the work. S 2.01 Required Contractor's License(s): A California "C-20" contractor's license is required to bid this contract. Joint ventures must secure a joint venture license prior to award of this Contract. 2.02 Substitution of Securities: Owner will permit the successful bidder to substitute securities for any retention monies withheld to ensure performance of the contract, as set forth in Document 00 6290 Escrow Agreement For Security Deposits In Lieu Of Retention and incorporated herein in full by this reference, in accordance with Section 22300 of the California Public Contract Code. 2.03 Prevailing Wage Laws: Pursuant to Part 7 of Division 2 of the California Labor Code (Section 1720 et seq.) the Contractor shall pay not less than the prevailing rate of wages to workers on this project as determined by the Director of the California Department of Industrial Relations. The Director's schedule of prevailing rates is on file and open for inspection at County of Kern, General Services Division of the County Administrative Office, 1115 Truxtun Avenue, Third Floor, Bakersfield, California 93301, and is incorporated herein by this reference. 2.04 Required Registration with the State of California Department of Industrial Relations: Pursuant to California Labor Code 1725.5, all contractors and subcontractors must be registered with the Department of Industrial Relations (DIR) in order to be qualified to bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code, or engage in the performance of any public work contract. For projects without Federal Funding, each Bidder must be licensed, as required by law, at the time the bid is submitted. For projects with Federal Funding, each Contractor must be licensed at the time the Contract is awarded. ARTICLE 3 - CONTRACTOR RESPONSIBILITY 3.01 Work by Contractor's organization: Except as hereinafter specified and otherwise authorized by the County, the Contractor shall self-perform with his own organization and trade labor forces employed by him not less than fifteen percent (25%) of the total amount of the actual Work in the designated specialty performed at the site under this Contract, computed on the basis of cost. The Contractor's overhead, standard General Conditions type cost (i.e. site clean up, traffic control, site maintenance, Etc.), superintendent and administrative support costs or material purchased for use on the work by others are some of the cost items that will not be considered toward the 25% goal for Contractor's work performed on site. The Contractor may subcontract the designated work if the Contractor fulfills the 25% requirement or with approval of the County. The Contractor shall require each Subcontractor to familiarize himself with all provisions of the Contract, which may affect his Work.
