Renovation of a municipal facility in Duluth, Minnesota. Completed plans call for the renovation of a municipal facility.
Work pertains to the installation of a new boiler system at the St. Louis County Courthouse located in Duluth, Minnesota. County may reject any response not prepared and submitted in accordance with these specifications but may waive any immaterial informality or reject any and all responses if in the public interest as determined in the sole discretion of the County. Any response may be withdrawn prior to the above scheduled time for the public opening or authorized postponement. Any response received after the time and date specified may not be considered. Responder may not withdraw a response within sixty (60) consecutive calendar days after the public opening. It is understood and agreed that this Request for Bids, Exhibits, any addenda issued by the County, the signed and sealed Response Form, signed Purchase Order, and Project Contract shall collectively constitute the Agreement between St. Louis County (Owner) and Responder (after award of response, hereinafter called "Successful Responder"), shall be referred to collectively as the Contract Documents, and all work conducted thereafter shall be completed in accordance therewith. Each response must be accompanied by a certified check or bid bond prepared on separate form of bid bond, duly executed by the Responder as principal and having as surety thereon, a surety company approved by County, in the amount of five percent (5%) of the response. Such certified checks or bid bonds will be returned to all except the three (3) lowest Responsible Responders within three (3) days after the public opening. The remaining certified checks or bid bonds will be returned promptly after Owner and the accepted Responder have executed the contract, or if no award has been made, within five (5) days or upon demand of the Responder at any time thereafter, so long as Responder has not been notified of the acceptance of their response. For any contract over $150,000.00, St. Louis County will require the successful Responder to furnish a Performance Bond and a Labor & Materials Payment Bond in the full amounts in favour of Owner. The surety company providing the bond(s) must be registered to do business in the State of Minnesota and be satisfactory to the Owner. Any attorney-in-fact who signs bid bonds or contract bonds must file with each bond, a certified and effectively dated copy of their power of attorney. The successful Responder, upon failure or refusal to deliver the bonds required within ten (10) days after receipt of notification of the acceptance of its response, shall forfeit to County the security deposited with the response as liquidated damages for such failure or refusal. Work is to be scheduled by Successful Responder in cooperation with the Owner and all work is to be completed within 90 consecutive working calendar days from the date indicated on the Notice to Proceed, except as may be extended in accordance with the Contract Documents. The envelopes containing responses shall be furnished by the responder, sealed and have attached to the lower left-hand corner, the label at the end of this document. Requests for additional information on Information for Responders shall be delivered to the St. Louis County Purchasing Division, located at the AP Cook Building on 2503 Rice Lake Road, Duluth, MN 55811 and/or Purchasing@stlouiscountymn.gov. County reserves the right to reject any response if the evidence submitted by, or investigation of, such Responder fails to satisfy County that Responder is a Responsible Responder and is properly qualified to carry out the obligations of the contract and to complete the work contemplated therein. The County will not provide verbal clarifications or interpretations of Contract Documents at the request of Responders. Any request for such clarification shall be in writing addressed to: St. Louis County Purchasing Division, located at the AP Cook Building on 2503 Rice Lake Road, Duluth, MN 55811 and/or Purchasing@stlouiscountymn.gov.
