Questions of substantial measure or requiring clarification of work to be completed may be answered at the meeting; however, the Architect/Engineer shall answer all such questions in writing in the form of an official addendum. no later than seven (7) days, not including Saturdays, Sundays, or holidays prior to the date for acceptance of the bids. The Monroe Township Board of Education hereby advertises for competitive bid pricing in accordance with N.J.S.A. 18A:18A-21(a) (b). bid Note: Bids must be submitted in a sealed envelope and delivered to the Office of the School Business Administrator/Board Secretary of Monroe Township Board of Education on or before the date and time indicated below. The envelope is to bear the following information: Title: Compressor Replacement Bid Number , Name and Address of the Bidder Bid Opening Date , Bid Opening Time. The bid envelope must be addressed to MONROE TOWNSHIP BOARD OF EDUCATION Attn: School Business Administrator/Board Secretary 423 Buckelew Ave Monroe Township, New Jersey 08831 Bids may also be submitted to the School Business Administrator/Board Secretary or their designee at the bid opening meeting prior to the advertised date and time. The School Business Administrator/Board Secretary shall publicly receive and open all bids on the advertised date and time. No bids shall be received after the time designated in the advertisement. (N.J.S.A. 18A:18A-21(b)). At this time the Board of Education does not accept electronic (e-mail) submissions of bids. "Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq." Each bid shall be accompanied by a bid bond, cashier's check, or certified check made payable to the Monroe Township Board of Education for ten percent (10%) of the amount of the total bid, however, not to exceed $20,000. No bid may be withdrawn for a period of sixty (60) days after the date set for the opening thereof. No oral or other communications during the bidding process shall bind the Owner except as shall be contained in a written Addendum which the Owner may, in its sole discretion, issue in accordance with Applicable Law. Bidders and their prime subcontractors are required to comply with all applicable New Jersey law, including, without limitation, the affirmative action requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq.: the Truth in Contracting requirements of P.L. 1999, c. 440; the business registration certificate requirements of P.L. 2004, c. 57; and other statutes and regulations, all as and to the extent applicable and whether or not said laws and requirements are specifically referenced in the Bidding Documents. A bidder on a public works project where the cost of the work exceeds $20,000.00 must first have been qualified by the Department of the Treasury, Division of Property Management and Construction, pursuant to N.J.S.A. 18A:18A-27 through 33, and shall submit with his bid a Prequalification Affidavit--No Material Adverse Change, a copy of a valid and active NOTICE OF CLASSIFICATION, a certified copy of a Total Amount of Uncompleted Contracts Form and such Affidavit that subsequent to the latest such statement submitted there has been no material adverse change in his qualification information except as set forth in said Affidavit. All contractors named in this bid shall possess a valid and current New Jersey Department of Labor and Workforce Development Public Works Contractor's Registration Certificate pursuant to N.J.S.A. 34:11-56.48 et seq., at the time the Board of Education receives the bid. It is the sole responsibility of the Bidder to ensure timely receipt of its Bid by the Owner, at the place designated for opening of bids. The Owner assumes no responsibility whatsoever in connection with any defects arising out of the issuance of the Bidding Documents or its failure to receive Bids at the time and place required and those which may arise from delay for any reason in obtaining the Bidding Documents or in the submission of a Bid, including, but not limited to, delays or failures of receipt caused by traffic delay, errors by messengers, mislabeling, mis-direction from any source including by the Owner's personnel, mis-delivery by common carrier, or any other reason. When it is in its best interest to do so and to the maximum extent of its discretion under applicable law, N.J.S.A. 18A:18A-22, the Owner may award the Contract in whole or in part, select any combination of Bids and alternates, may waive any informalities, and may reject any or all Bids in the best interest of the Board. Pursuant to N.J.S.A. 18A:18A-42 the term of this contact shall be for one year from the date of the Board's signature; provided, however, that the board may extent this contract as its sole option for two additional one-year terms or one additional two-year terms. Not to exceed a total of three years. Statement of Ownership Requirement: Pursuant to N.J.S.A. 52:25-24.2, Bidders shall submit a statement setting forth the names and addresses of all persons and entities that own ten percent or more of its stock or interest of any type at all levels of ownership. A Non-Collusion Affidavit and a Contractor Questionnaire/Certification also must be submitted with the bid. The bid package will also include other documents that must be completed and returned with the bid. Failure to comply with Instructions to Bidders and to complete and submit all required forms may be cause for disqualification and rejection of the bid. The Board of Education reserves the right to reject any non-responsive bids or all bids, pursuant to N.J.S.A. 18A:18A-22, and to waive minor informalities or non-material exceptions that may be in the best interest of the Board.
