No questions are to be directed to Town personnel. It is the intent ofthese guidelines that the State ofNorth Carolina, as awarding authority for construction projects, and the contractors and subcontractors performing the construction contracts awarded shall cooperate and in good faith do all things legal, proper and reasonable to achieve the statutory goal of fifteen percent (15%) for participation by minority businesses in each construction project as mandated by GS 143-128.2. Nothing in these guidelines shall be construed to require contractors or awarding authorities to award contracts or subcontracts to or to make purchases ofmaterials or equipment from minority-business contractors or minority-business subcontractors who do not submit the lowest responsible, responsive bid or bids. All bidders must follow the Guidelines for Recruitment and Selection of Minority Business for Participation in Construction Contracts as Revised November 1, 2002. All bidders must include with their bids an Affidavit (1) attesting to the Contractor's compliance with E-Verify (or, if the Contractor employs less than 25 employees in this state, attesting to that fact), and (2) attesting to the Contractor's subcontractors' compliance with E-Verify (or, if any subcontractors employ less than 25 employees in this state, attesting to that fact). Bid security shall be furnished in accordance with the Instructions to Bidders. The Owner reserves the right to reject any Bid for failure to comply with all requirements of this notice or the Contract Documents; however, the Owner may waive any minor defects or informalities at their discretion. The Owner further reserves the right to reject any and all Bids or award the contract in their best interest.
