WESTERN BERKS WATER AUTHORITY will receive sealed bids via the online PennBid Program for Water Treatment Plant Improvements. All Bidders must submit a bid security in the amount of 10% of the lump sum base bid. The successful bidder will be required to provide a performance bond in the amount of 100% of the successful bid amount. Each Bid must be accompanied by a certified check, bank money order, or a Bid Bond in an amount not less than 10 percent of the Bid total, payable to the Owner in accordance with the Instructions to Bidders. Applicable laws and regulations include the Commonwealth of Pennsylvania "Steel Products Procurement Act" - Act No. 3 of 1978 as amended, Application of American Iron and Steel Requirements, and U.S. Department of Labor Federal Wage Determination Decision. Bidders are subject to all applicable provisions of the Federal Davis Bacon Act Wage Determinations and the Build America, Buy America Act as set forth in the Project Manual. All contractors are required to ensure that employees and applicants will not be discriminated against because of race, creed, color, religion, sex, age, handicap, marital status, or national origins, and must meet federal and state law regarding non-discrimination. Contractors must demonstrate compliance with federal Executive Orders 11625, 12138, 12432, and EPA Regulations at 40 CFR Part 33, including the solicitation of Disadvantaged Business Enterprises (DBEs) through the Six Good Faith Efforts. Documentation of DBE solicitation efforts must be submitted with the bid. Failure to submit this documentation may cause a bid to be rejected.
