Statement of Ownership Requirement: Pursuant to N.J.S.A. 52:25-24.2, Bidders are required by law to submit a Statement of Ownership Disclosure form statement setting forth the names and addresses of all persons and entities that own ten (10%) percent or more of its stock or interest of any type at all levels of ownership. Pursuant to P.L. 2004 c.57, (N.J.S.A. 52:32-44) all bidders and subcontractors must have a New Jersey Business Registration Certificate issued by the New Jersey Department of Treasury, Division of Revenue, a the Elizabeth Board of Education prior to the contract award. Bidders are required to comply with the requirements of N.J.S.A. 10:2-1 et seq., "The Law Against Discrimination" and Affirmative Action, N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27-1 et seq. A bidder on a public works project for a Public Schools where the cost of the work exceeds$20,000mustfirst have been qualified by the Department of the Treasury, Division of Property Management and Construction, pursuant to N.J.S.A. 18A:18A-27 through 33, and shall submit with his bid a Pre qualification Affidavit--No Material Adverse Change, a copy of a valid and active NOTICE OF CLASSIFICATION, a certified copy of a Total Amount of Uncompleted Contracts Form and such Affidavit that subsequent to the latest such statement submitted there has been no material adverse change in his qualification information except as set forth in said Affidavit. Bidders shall be prequalified in one of the following categories: C008 GENERAL CONSTRUCTION; and/or C009 GENERAL CONSTRUCTION/ALTERATIONS & ADDITIONS No bidder who is on the State Treasurer's or the Federal Government's List of Debarred, Suspended or Disqualified Bidders shall be eligible to bid on this project. The Elizabeth Board of Education does not accept electronic (email) submissions of bids at this time. No bid may be withdrawn for a period of sixty (60) days from the opening of the bids. The Elizabeth Board of Education reserves the right to reject any or all bids pursuant to N.J.S.A. 18A:18A-22,those deemed to be non-responsive, and those bids submitted by bidders deemed not to be responsible under the Public-School Contracts Law. The Elizabeth Board of Education may also waive any informality in the bidding process in accordance with the law if it is in the best interest of the Elizabeth Board of Education. The contract, if awarded, shall be awarded to the lowest responsible bidder whose bid is responsive in all material respects to the bid requirements.
