The work, in general, consists of, but is not limited to, providing services and chemicals and certain testing equipment incidental to protect the system from scale, corrosion, and microbio in the boilers and chiller systems throughout City of Monterey, Presidio of Monterey, and Defense Human Resources Activity (DHRA) Enterprise Operation Center (DEOC). The work shall include, but not be limited to, monthly onsite services visits consisting of review of inspections, chemical inventory, corrosion review, training, treatment report and recommendations, and chemical analysis of discharge wastewater as needed. All questions submitted and answers provided shall be electronically distributed to all bidders who have selected to follow this Specification on online. The terms of this Job Order contract shall remain in effect for one year from the effective date of the Notice to Proceed or until the contract amount of $100,000 is spent, whichever comes first. The agreement will include an option for two (2) additional one (1) year extensions with a not to exceed annual funding limit of $100,000. The total term of this agreement will not exceed three (3) years. The amount of work to be requested during the initial one year or optional two additional one-year contract periods cannot be well defined at the outset. Work shall be issued through work orders At the time of the bid opening, the successful Bidder must be legally entitled to perform contracts requiring a Qualified Applicator License (QAL), as the chemicals used are classified as federally restricted-use pesticides or state restricted materials. The license is issued by the California Department of Pesticide Regulation (CDPR), as boiler water treatment chemicals may be considered pesticides if they are used to control living organisms (e.g., bacteria, algae). Any Bidder or contractor not so licensed shall be subject to all penalties imposed by law. All contractor and subcontractor license(s) must remain in good standing throughout the term of the Contract. The Contractor shall notify the City in writing in the event its license is suspended, expires, or has a change in signatory. No Bidder may withdraw their bid for a period of ninety (90) days from the Bid Opening Date, which time shall be used by the City for reviewing the bids and investigating the qualifications of Bidders, prior to awarding of the contract. In the event of a bid mistake resulting from a clerical error made by the Bidder, withdrawal of such bid may only be allowed if the criteria set forth in California Public Contracts Code Sec. 5103 are met and the procedures set forth therein are followed; any such approval by City of bidders request to withdraw bid shall be at the sole discretion of the City. The City reserves the right to reject any or all bids as the best interests of the City may dictate and, to the extent permitted by law, waive any irregularity in any bid. If there is any reason for believing that collusion exists among the bidders, the City may reject any or all bids.
