All products and/or services furnished must comply with all applicable federal, state, and local codes and regulations. All bids must include, and the selected vendor must pay, all applicable taxes on both labor and materials, except for Federal Excise and State Sales Taxes, which are not to be included. The Board of Education reserves the right to qualify or disqualify bidders based on available information about their ability to perform and the suitability of the products and/or services. The District may request information such as performance records, business address, equipment lists, financial statements, project history, and other relevant data. Vendors must not discriminate in employment, must conduct criminal background checks on all staff with unsupervised access to school property, and must certify no assignment of individuals with felony convictions or convictions relating to abuse, neglect, or endangerment of a minor. The specifications set forth define minimum acceptable quality, and products/services must be from nationally recognized manufacturers regularly serving the school market. Variations from specifications must be fully explained in the bid. The District may increase or decrease quantities or modify specifications with written agreement from the vendor. All bids must be submitted in opaque, sealed envelopes, with no oral, telephonic, email, or fax bids accepted. Bids may be withdrawn prior to the scheduled opening but cannot be withdrawn for sixty days after opening. A signature page must be included. The contract is awarded upon formal notice. Vendors must provide a one-year guarantee on workmanship and materials. A notarized familial disclosure affidavit and an Iran Linked Business affidavit are required. The District reserves cancellation rights for non-performance and has a no-smoking policy on school premises.
