The City of West Bend, Wisconsin, reserves the right to reject any or all bids, subject to the provisions of Sections 62.15 and 66.0901 of the Wisconsin Statutes. No bid shall be withdrawn for a period of 60 days after the scheduled time of opening bids. The letting of work described herein is subject to the provisions of Section 66.0901 Wisconsin Statutes, as it applies to work done under this contract. No bid will be received unless accompanied by an uploaded Bid Bond or electronic Surety2000 bid bond equal to 5% of the bid, payable to the City of West Bend, Wisconsin, as a guarantee that, if the bid is accepted, the successful bidder will execute and file the contract and payment and performance assurances, forming a part of the Specifications, within 10 days after the award of the contract. The payment and performance assurances must be for an amount at least equal to the contract price and must be in the form of a bond, an irrevocable letter of credit, or an escrow account acceptable to the City. In case the bidder fails to file such contract, performance bond, and payment bond, the amount of the check or bid bond shall be forfeited to the City as liquidated damages (Section 62.15(3) of Wisconsin Statutes)
