Upstate Medical University intends to make an award under discretionary authority for two (2) Replacement Reco Hot Water Heaters. The purchase is pursuant to New York State Education Law §355(5)(a), which allows certain purchases without a formal competitive process, including from NYS small businesses, businesses certified under Article 15-A of the NYS Executive Law, and, if applicable, from businesses selling recycled or remanufactured commodities. Interested vendors must contact the designated campus contact within fifteen (15) business days of this notice. A sealed bid will not be held. This procurement is subject to NYS Finance Law §§139–j & –k, known as the Lobbying Law, so only the listed contacts may be approached regarding this procurement. The successful contractor will be required to submit applicable documents related to Vendor Responsibility, NYS Finance Law §§139–j & –k, NYS Tax Law Section 5-a, and valid and current NYS Workers’ Compensation and Disability forms. NYS Small Business and businesses certified under Article 15-A are encouraged to submit bids.
