Additional elements are road patching at spot repairs and manhole boxouts, seeding, mulching, fertilizing, and other miscellaneous construction improvements. All work is to be completed under a single contract. Bids must include a 10% bid security, and the successful bidder is required to provide a 100% performance and payment bond. Substitutions of materials or equipment must be submitted in writing with documentation and are subject to the owner’s or engineer’s approval. The project is subject to Davis Bacon Wages, Build America Buy America (BABA) requirements, and Section 3 Regulations. Bidders must comply with all HUD Section 3 requirements, including prioritizing economic opportunities for low- and very-low-income persons, posting notices, maintaining records, and meeting all Section 3 benchmarks. All iron, steel, manufactured products, and construction materials must be produced in the United States unless excepted by a waiver, and the contractor must provide all required documentation for compliance. The bidder’s proposal must be made on the provided forms, with all required information supplied prior to the bid opening. The owner reserves the right to reject any or all bids and to waive informalities in the bidding process. No bid may be withdrawn for sixty days after bid opening.
