Reclamation of one abandoned mine portal and one vertical opening. The work to be performed under the terms of this Specification consists of the reclamation of a one small abandoned mine portal (P) and one vertical opening (VO) on the MINES ROAD PORTALS PROJECT located near 6196 Mines Road, Pulaski, Pulaski County, Virginia, for the Commonwealth of Virginia. The intent of this Specification is to prescribe the complete work to be performed. The specification is written to permit and direct the work to be conducted by the selected Contractor. If there are any contradictions between the Specifications and Drawings, the Contractor shall bring these facts to the attention of the Agency and obtain the Agency's decision as to the true meaning and intention. The Contractor remains responsible for timely identifying any conflicts as may be found to the attention of the Agency. In the absence of a formal written response from the Agency, or in the event the Contractor fails to bring such facts to the attention of the Agency, the Contractor is responsible for ensuring compliance with the most stringent requirement. A. The Contract Documents are complementary, and the Contractor shall promptly review the Drawings, Specifications, and other Contract Documents upon receipt and prior to commencing the Work. B. If the Contractor discovers any discrepancy, conflict, ambiguity, omission, or error in the Contract Documents, or identifies any condition that appears inconsistent with the intent of the Contract Documents, the Contractor shall immediately notify the Agency in writing and request clarification before proceeding with the affected Work. C. The Contractor shall not proceed with the affected Work until written direction has been issued by the Agency. The Agency shall determine the appropriate interpretation or resolution of the discrepancy, conflict, ambiguity, omission, or error. The Contractor shall perform the Work in accordance with the Agency's written direction. D. The Contractor shall be responsible for any costs associated with performing Work without first notifying the Agency of a known discrepancy, conflict, ambiguity, omission, or error in the Contract Documents. Such Work may be subject to removal and replacement at no additional cost to the Commonwealth E. No information or instructions in this Section shall be construed to authorize the Contractor to independently interpret, modify, or resolve conflicts in the Contract Documents, or to proceed with Work, based upon the Contractor's own interpretation where clarification from the Agency is required.
