A Performance Bond and a Labor and Material Bond, both of which Bonds shall be on the form prescribed by the Fund and in an amount not less than 100 percent of the total amount of the Contract awarded to the Contractor by the Fund. Said Bonds must be issued by a surety company approved by the Fund and authorized to do business in the State of New York as a surety. Attorneys-in-fact who execute said Bonds on behalf of a surety must affix thereto a certified and effectively dated copy of their power of appointment.
