All bids must be made on said forms and must be signed by the bidder, with his business address and place of residence. Each bid must be secured by an accompanying deposit in the amount of five (5%) percent of the bid in the form of a bid bond, cash, or certified check, or a treasurer's or cashier's check issued by a responsible bank or trust company payable to the Town of Belmont. A bid bond shall be in a form satisfactory to the Board of Selectmen, with a surety company qualified to do business in the Commonwealth of Massachusetts, and conditioned upon the faithful performance by the principal of the agreements contained in the bid. The bid deposit of the three (3) lowest responsible and eligible bidders will be retained until the Contract has been duly executed, and then returned, or if no award is made, then at the expiration of thirty (30) days. All other bid deposits will be returned within five (5) days after the date set for the opening of the bids, Saturdays, Sundays and legal holidays excluded. The bid bond, cash, cashier's check, or certified check payable to the Town of Belmont will be the property of the Town, and the amount thereof is the amount of damages which the Town will sustain by failure to carry out the bid if accepted by the Town, but if the bid is not accepted, or if notice is mailed or delivered and the undersigned executes and delivers said Contract and bond aforesaid, the check, or its amount is to be paid to the Bidder on receipt therefore. Performance and payment bonds in the sum of one hundred (100%) percent of the total bid with a surety company as surety, acceptable to the Select Board, shall be required for the faithful performance of the Contract and payment of subcontractors and suppliers. Bidders are advised that, by submitting a bid, each agrees that it has examined the site, that the specifications are adequate, and that the required results can be produced under the specifications. No claims for extra work will be allowed because of alleged impossibilities in the production of the results specified or because of inadequate or improper specifications. Minimum wage rates are to be paid for this project as established in accordance with General Laws, Chapter 149, Sections 26 - 27D , as amended. The Contractor shall provide all labor and materials in accordance with OSHA standards and regulations. The successful bidder shall be required to submit documentation that all employees to be employed in the work subject to this bid have successfully completed a course in construction safety and health approved by the United States Occupational Safety and Health Administration that is at least 10 hours in duration. Any employee found on a worksite subject to this section without documentation of successful completion of a course in construction safety and health approved by the United States Occupational Safety and Health Administration that is at least 10 hours in duration shall be subject to immediate removal. The Select Board reserve the right to reject any or all bids and to make the award as may be determined to be in the best interests of the Town of Belmont.
