St. Charles County is seeking Statements of Qualifications for design and engineering services for the DESIGN AND ENGINEERING OF SPRING BEND PARK AND HERITAGE PARK. The County reserves the right to terminate the contract for reasons of violations by the successful proposer of any term or condition of the contract by giving thirty (30) days written notice stating the reasons therefore and giving the party ample time to remedy the deficiencies. All questions must be received no later than 3:00 PM on Friday, June 30, 2023. Any question received after this deadline may not be answered. CONSULTANT's services shall consist of the phases set forth in Exhibit "A", attached hereto and made a part hereof, and shall include civil, structural, mechanical, and electrical engineering and architectural services, as applicable for the Project. CONSULTANT shall provide all services as set forth in Exhibit "A" including all necessary, incidental, and related activities and services required by the Scope of Services and contemplated in CONSULTANT's level of effort. 3.2 CO CONSULTANT and COUNTY acknowledge that the Scope of Services does not delineate every detail and minor work task required to be performed by CONSULTANT to complete the Project. If, during the course of the performance of the services included in this Agreement, CONSULTANT determines that work in addition to the Scope of Services should be performed to complete the Project, CONSULTANT shall notify Contract Administrator in writing in a timely manner before proceeding with the work. Notice to Contract Administrator does not constitute authorization or approval by COUNTY to perform the work. Performance of work by CONSULTANT outside the originally anticipated level of effort without prior written COUNTY approval is at CONSULTANT's sole risk. 3.3. COUNTY and CONSULTANT acknowledge that Exhibit "A" is for the first portion of services related to the Project and that additional negotiations will be required for subsequent phases. The COUNTY and CONSULTANT may negotiate additional scopes of services, compensation, time of performance and other related matters for future phases of Project. If COUNTY and CONSULTANT cannot contractually agree, COUNTY shall have the right to immediately terminate negotiations at no cost to COUNTY and procure services for future Project phases from another source
