CDBG ADA Ramp Improvements Project Phase 14. Question Deadline 12/13/2023 at 10:00 AM PT. LIQUIDATED DAMAGES In accordance with Government Code section 53069.85, it is agreed that the Contractor will pay City the sum of two thousand five hundred dollars ($2,500) for each and every calendar day of delay beyond the time prescribed in the Contract Documents for finishing the Work, as Liquidated Damages and not as a penalty or forfeiture. In the event that Liquidated Damages are not paid, the Contractor agrees City may deduct that amount from any money due or that may become due the Contractor under the Contract. This Article does not affect the City's rights to other damages or remedies specified in the Contract Documents or allowed by law. SCOPE OF WORK The Contractor shall perform all Work within the time stipulated the contract and shall provide all labor, materials, equipment, tools, utility services, and transportation to complete all of the Work required in strict compliance with the Contract Documents as specified in COMPONENT PARTS OF THE CONTRACT section below for the following Project. Summary ADA Ramp Improvements Project Phase 14 would reconstruct eight (8) existing sidewalk access ramps to comply with current standards and requirements of the Americans with Disabilities Act (ADA). This project implements the City's ADA self-assessment and transition plan and is funded through allocation of Community Development Block Grant (CDBG) funds. Implementation of ADA self-assessment and transition plan provides an investment and maintenance of infrastructure proactively enhancing the visual character of the city, supporting quality neighborhoods and maintenance of City assets. City reserves the right to reject any or all bids or to waive any irregularities or informalities in any bids or in the bidding process. Bids must be accompanied by cash, a certified or cashier's check, or a Bid Bond in favor of the City in an amount not less than ten percent (10%) of the submitted Total Bid Price. The successful bidder will be required to furnish City with a Performance Bond equal to 100% of the successful bid, and a Payment Bond equal to 100% of the successful bid, prior to execution of the Contract. This project is being financed with Community Development Block Grant funds from the U.S. Department of Housing and Urban Development (24 CFR Part 570) and subject to certain requirements including: compliance with Section 3 (24 CFR Part 135) Economic Opportunities requirements; payment of Federal Davis-Bacon prevailing wages, as applicable; Federal Labor Standards Provisions (HUD 4010); Executive Order 11246; and others as described in Appendix E below.
