Vermont State Colleges (OWNER) proposes improvements to the water system serving the buildings located at 1540 and 1538 VT Route 66 in Randolph, Vermont (PROJECT). All questions by prospective BIDDERS as to the interpretations of the CONTRACT DOCUMENTS must be submitted in writing to the ENGINEER at least seven (7) days before the date herein set for the opening of bids. Responses to questions in the form of an addendum will be provided by the ENGINEER no later than five (5) days before the date of opening bids via addendum. Failure of any BIDDER to receive any such addenda or interpretation shall not relieve such BIDDER from any obligation under its bid as submitted. All addenda so issued shall become part of the CONTRACT DOCUMENTS. The OWNER may make such investigations as it deems necessary to determine the ability of the BIDDER to perform the WORK, and the BIDDER shall furnish to the OWNER all such information and data for this purpose as the OWNER may request. The OWNER reserves the right to reject any bid if the BIDDER fails to submit the required information and data, or the evidence submitted by, or investigation of, such BIDDER fails to satisfy the OWNER that such BIDDER is properly qualified to carry out the obligations of the Agreement and to complete the work contemplated therein. Note that the Agreement provided with the Information for Bidders is a form agreement and the OWNER reserves the right to make changes to the form or substance of that document as part of a negotiated process and/or on the advice of counsel in developing a final Agreement for signature by the parties.
