The work for contract 2024-01: Lagoons Sludge Dredging Project generally includes: removing and dewatering of sludge stored in Primary Aeration Lagoon No. 1 and Tertiary Lagoon No. 1, providing on-site storage containers for dewatered sludge, and transporting dewatered sludge from Owners Wastewater Treatment Facility to the Lanchester Landfill. Estimated Contract Value: $550,000 to $650,000. All questions shall be submitted using Bidding Documents Website (PennBID) Bid security in the form a Certified Check or Bid Bond shall be furnished with the bid in an amount not less than 10%. For all further requirements regarding bid submittal, qualifications, procedures, and contract award, refer to the Instructions to Bidders that are included in the Bidding Documents. Statutory Requirements. Bidders must comply with all State antibid-rigging regulations pertaining to work associated with this project and will be required to submit an executed non-collusion affidavit with the bid. Bidders should refer to provisions of federal and state statutes, rules and regulations dealing with the prevention of environmental pollution and preservation of public natural resources that affect the project, pursuant to Act No. 247 of the General Assembly of the Commonwealth of Pennsylvania, approved October 26, 1972. This Project falls under The Commonwealth of Pennsylvania enacted Act 127 of 2012, known as the Public Works Employment Verification Act ('the Act') which requires all public work contractors and subcontractors to utilize the Federal Government's E-Verify system to ensure that all employees performing work on public work projects are authorized to work in the United States. All Bidders are required to submit a Public Works Employment Verification Form as a precondition for the Contract Award. The estimated cost for each Contract is greater than Twenty-five Thousand Dollars ($25,000) and the Davis Bacon Wage Rates shall apply. All bids shall be irrevocable for 60 days after the bid opening date unless award is delayed by a required approval of another government agency, the sale of bonds, or the award of a grant or grants, in which case this Bid shall remain subject to acceptance for 120 days after the bid opening date as provided by the Act of November 26, 1978 (P.L. 1309, No. 317), as amended by the Act of December 12, 1994 (P.L. 1042, No. 142). All bidders are hereby notified that in regard to any contract pursuant to this advertisement, businesses will be afforded full opportunity to submit bids in response to this notice and will not be subjected to discrimination on the basis of gender, race, color, creed, sex, age, physical disability or national origin in consideration for an award. Similarly, the successful bidder shall in no manner discriminate against or intimidate any employee involved in the manufacture of supplies, the performance of work, or any other activity required under the contract on account of gender, race, creed or color. This Project is being federally funded by EPA financial assistance dollars and therefore requires all contractors to demonstrate compliance with federal Executive Orders 11625, 12138 and 12432 and EPA Regulations at 40 CFR Part 33, through the detailed documentation of solicitation of Disadvantage Business Enterprises (DBEs). Contractors must demonstrate the Six Good Faith Efforts to identify and solicit DBE firms that are potential sources for any procurement action in the areas of project construction, equipment, services and supplies by including state qualified small businesses, and minority and women owned business enterprises in the bidding process. The Northwestern Chester County Municipal Authority reserves the right to waive any defects, errors, omissions, mistakes, informalities, to accept any bid or combination of bids that are deemed to be in the best interest of the Northwestern Chester County Municipal Authority, and to reject any or all proposals. **Document Notes: Bidding Documents may be downloaded from the designated website. Prospective Bidders are urged to register with the designated website as a plan holder, even if Bidding Documents are obtained from a plan room or source other than the designated website in either electronic or paper format.
