CONTRACT WASTE HAULER SERVICES FOR COLLECTION AND DISPOSAL OF RESIDENTIAL WASTE, REFUSE, AND RECYCLING SERVICES The Mayor and Board of Aldermen of the City of Brookhaven,Mississippi(the "City") is soliciting sealed written proposals,pursuant to Miss. CODE ANN 31-7-13 (Supp. 2003) (the "Act")to furnish all labor, materials,work and services (cumulatively, the "Contract Waste HaulerServices" or the "Services") forthe collection and disposal ofResidential Waste, Refuse andRecycling Services within thecurrent corporate limits of theCity or as hereafter expanded,as described in the specifications (the "Specifications"). Proposals shall be typewrittenor printed in ink and only on theforms provided. Proposals mustbe submitted in a sealed envelope. The person signing theproposal shall initial all corrections or erasures. Each entityor person submitting a proposalpursuant to this RFP shall bereferred to as a "Proposer" or"Respondent". A proposal maynot be modified, withdrawn orcanceled by the Proposer for aperiod of one hundred twenty(120) days following the dateand time designated for receiptof proposals. It is understood that the Cityreserves the right to reject anyand all proposals, and to waiveinformalities in proposals, andto select the proposal or proposals that, in the opinions ofthe City shall be the most qualified proposal, on the basis ofprice, financial responsibility,technology, legal responsibilities and other relevant factors.The City reserves the right toaward an overall contract basedupon all proposals submitted. All information submitted in response to the Request for Proposals will be considered publicinformation after all proposalsare opened. No telephonic, telegraphic orfacsimile proposals will be accepted. Proposals receivedafter the date and time listedfor receipt will be returned unopened to the Proposer. Proposals must be clearly identified as such on the front of thesealed envelope in which theproposal is submitted, and thewords "Proposal for ContractWaste Hauler Services" shouldbe clearly written on the front ofthe envelope. Responsibility fortimely submittal lies solely withthe Proposer. Proposals submitted after 2:00 P.M. local time onMonday, June 3, 2024 will notbe opened or considered. Should any Proposer find anydiscrepancies, or omissionsfrom, the Specifications in anyother proposed contract documents, or should the Proposerbe in doubt as to their meaning,he should at once notify andobtain an interpretation or clarification from the City's Agent,Kris Xifos, Director of PublicWorks. Every request for an interpretation and/or clarification,whether relating to specifications or requirements, shall bemade in writing and addressedto the City's Agent. Writtenquestions may be submitted byfacsimile. The deadline for asking interpretations, clarificationsor questions shall be 5:00 P.M.local time on Tuesday, May 15,2024. All responses to such willbe given to the Proposers inwriting no later than 5:00 P.M.local time on Monday, May 17,2024. Any interpretation or clarification given in accordancewith such request and pursuantto this provision shall be madeonly by the City's Agent, withthe advice of the City Mayor andthe City Attorney, and shall be inwriting, with copies forwarded toall parties requesting bid specifications. No oral interpretation,instruction or information givenby any employee or agent of theCity shall be binding. The Cityreserves the right to officiallymodify or cancel this RFP afterissuance. Such modificationsshall be made only by writtenaddendum furnished by theCity's Agent, an acknowledgement of which must be submitted with the Respondent's proposal. EachProposer should also be prepared to respond to the Requestfor Proposals for alternative services. The estimated quantitieslisted herein are solely for thepurposes for comparison andevaluation proposals. A proposal/bid security in theform of a certified or cashier'scheck or bid bond by a corporate surety licensed to do business in Mississippi and acceptable to the City, in the sum of$50,000.00 shall be required tobe submitted with the proposal.The bonds required must beaccompanied by a certificateof the surety certifying that theAgent who executed the bondwas authorized to bind the surety company as of the date of thebond and qualified to do business in the State of Mississippi. Respondents should submitone original and eight copiesof their proposal. The originalmust be clearly marked andmust contain the original signatures on all proposal forms.
