The City of Topeka intends to enter into a written agreement with multiple contractors submitting pricing for the work described in these specifications. Work performed under the resulting contracts will consist of furnishing all labor, equipment, and material to restore disturbed areas after an emergency underground utility repair is completed, from City ("Owner") owned assets associated with the site restoration related to water, wastewater, and stormwater infrastructure. Such work will be limited to water, wastewater, and stormwater infrastructure. Restoration work will be managed throug the City's Utility Repair and Inspection Unit (URI). The City of Topeka, Standard Technical Specifications Current Edition shall be considered an integral part of these specifications. All work performed by the Contractors shall be completed per the Standard Technical Specifications. All work requires the approval of URI staff. Traffic Control for each job will be administered through the Citywide Temporary Traffic Control (TTC) Contractor as stated in the Traffic Controls section of these specifications. Owner May Stop the Work: If the Work is defective, or Contractor fails to supply sufficient skilled workers or suitable materials or equipment, or fails to furnish or perform the Work in such a way that the completed work will conform to the Contract Documents, Owner may order Contractor to stop the Work, or any portion thereof, until the cause for such order has been eliminated; however, this right of Owner to stop the Work shall not give rise to any duty on the part of Owner to exercise this right for the benefit of Contractor or any other party. Accordingly, each Contractor assigned to each specific job/project is subject to liquidated damages. A cost of $50.00 and all fees associated with the cost of TTC will be assessed to the Contractor for each day beyond the completion time specified. The term of these resulting contracts shall be from June 1, 2024 through May 31, 2025, inclusive of the unit pricing being held firm for the term of each contract.
