1. The City is selling the houses and contents only and will retain the land as highway ROW. The successful bidder is responsible for removal/moving of the houses and contents after purchase, including but not limited to any site prep, demolition, and disconnection and capping of all utilities. 2. No Warranty Given. The houses are being sold as-is, where-is, and without recourse. No express warranty or guarantee of any kind is given by the City as to the description, quality, condition, or any other aspect of this house, and no claim for allowance on such a basis will be considered. The City disclaims all implied warranties, Including the Implied Warranties of Merchantability or Fitness for a Particular Purpose. No City official, employee or agent of the City has the authority to make or give any warranty of any kind whatsoever. 3. The buyer is responsible for their own due diligence in regards to applicable taxes, licenses, securing necessary permits, environmental, etc. 4. (10%) of the bid price in non-refundable certified funds must be paid by the high bidder to the City of Stillwater prior to Notice to Proceed. 5. The balance of the successful high bid will be due in certified funds within thirty (30) calendar days after Notice to Proceed. Owner Rights: The City reserves the right to accept or reject any or all bids or parts of bids and/or to award to more than one bidder if such action would be in the best interest of the City. Bond Notes: If the contract will require a Performance Bond, Maintenance Bond, and/or Statutory Bond, the standard forms will be available under the attachments tab and acknowledgement of the requirement will be a check box under the attributes tab. These bonds are required with the signed contract if your Bid is selected for contract award. The required Bid Bond shall be made payable to the Owner ("City of Stillwater") for the sum of 5% of the Bidder's bid total. If the successful Bidder fails to execute and deliver the Contract Documents and furnish the required bonds and insurance within the timeframes set forth in the Contract Documents then Owner may annul the award and the bid bond of that Bidder shall be forfeited.
