The Owner reserves the right to reject any and all proposals or bids and to waive any defects, irregularities or information in any proposal or bid, and to award the contracts to other than the lowest bidder, if in their discretion the interests of the project will be best served thereby. Performance/Payment Bonds are required. For construction or facility improvement contracts or subcontracts exceeding $150,000, the following minimal Federal requirements for bid guarantees, performance bonds, and payment bonds must be met. These include: 1. A bid guarantee from each bidder equivalent to five percent (5%) of the bid price. The bid guarantee must be a firm commitment in the form of a bid bond, certified check, or other negotiable instrument as assurance that the bidder is prepared to execute a contract within the time specified for the bid amount. 2. A performance bond from the (sub)contractor for one-hundred percent (100%) of the contract price to secure the sub(contractors fulfillment of all obligations under the contract. 3. A payment bond from the sub(contractor) for one-hundred percent of the contract price to assure payment of all persons supplying labor and material under the contract.
