Construction of Storm Drainage Facilities in Drainage Area "S" Bids are required for the entire work described in the Engineer's Estimate of Quantities following. The quantities are approximate only, being given as a basis for the comparison of bids, and the Board of Directors does not expressly or by implication agree that the actual amount of work will correspond therewith but reserves the right to increase, or decrease, the amount of any class or portion of the work, or to omit portions of the work, as may be deemed necessary or advisable by the Engineer. Cash, a cashier's check, certified check or bidder's bond, in the amount of not less than ten percent (10%) of the amount of the bid, shall accompany each proposal, made payable to the order of the Fresno Metropolitan Flood Control District, as a guarantee that the bidder will, after being notified of the acceptance of their bid, make a contract with the Fresno Metropolitan Flood Control District in accordance therewith, and will furnish the required contractor's bonds. The bonds required of the successful bidder are a faithful performance bond in the amount of one hundred ten percent (110%) of said bid and a payment bond in an amount equal to one hundred percent (100%) of the amount of said bid, in accordance with the provisions of Sections 3247-3251 of the California Civil Code. If the successful bidder fails to execute the contract for which the bid is accepted and fails to furnish the required bonds within ten (10) days after the mailing of notice of the award of the contract to the successful bidder, the Board of Directors shall have just cause for annulment of the award and forfeiture of the proposal guarantee. In this case, the Board of Directors reserves the right to award the contract to one of the other bidders or reject all bids. Award or Rejection of Bids. The contract will be awarded to the lowest responsible bidder complying with these instructions and with the advertised Notice to Contractors inviting bids. The Fresno Metropolitan Flood Control District, however, reserves the right to reject any or all bids, or to waive any or all bids, or to waive any informality in a bid. The fact that the District may have awarded the contract pursuant to a waiver of irregularity by the successful bidder shall not excuse forfeiture of the proposal guaranty in the event the bidder refuses to execute the contract. The Board of Directors reserves the right to reject any or all bids, to award or reject any combination of items as it sees fit, and to waive any informality in any bid received.
