Said bid security shall be forfeited to the OWNER as liquidated damages should the successful BIDDER fail to enter into a contract with the OWNER in accordance with the bid proposed as described in the bidding documents. The BIDDER will be required to furnish a performance bond and a labor and materials payment bond. No bid may be withdrawn within a period of forty-five (45) days after the date fixed for Opening Bids. The OWNER reserves the right to reject any or all Bids, to postpone the award of the contract for a period not to exceed 45 days after the bid opening and to waive any informalities and irregularities in Bids, and to accept the proposal deemed most advantageous to the best interest of the OWNER.
