The Project consists of furnishing all qualified professional personnel, supervision, construction labor, equipment and specified materials including 2"and 3" schedule 40 conduit or polypipe and vaults. Contractor will be responsible to install conduit by primary means of horizontal directional drilling and install power vaults as specified. All Work shall be substantially completed 90 days after issuance of Notice to Proceed to the awarded Contractor. The work is a public works project subject to ORS 279C.800 to 279C.870 or 40 U.S.C. Section 3141, et seq.; prevailing wage rate of pay does apply to this Project. The awarded Contractor is required to have a Public Works Bond on file with the Oregon CCB before work begins. Contractors must be qualified in accordance with the applicable parts of ORS 279C in order to enter into a contract with the Owner for public work in Oregon and shall have a minimum of four years' experience on projects of similar size and complexity to this Work. This check or bid bond shall be given as a guarantee that if awarded the contract for construction of the Project, the successful bidder will execute the attached contract and furnish a properly executed Performance and Payment Bond in the full amount of the Contract Price within ten calendar days after the date of the Owner's Notice-of-Award. Any bidder submitting a Bid accepted by the Owner shall file with the Owner, at the time of execution of the contract, a Performance and Payment Bond of the form bound herewith in the full amount of the Contract Price, as security for the faithful performance of the contract and the payment of all persons supplying labor and materials of the construction of the work, and to cover all guarantees against defective workmanship or material, or both, for a period of one (1) year after the date of final acceptance of the work by the Owner, per ORS 279C.380(3) McMinnville Water & Light may reject any Bid not in compliance with the contract provisions and all prescribed Public Contracting procedures and requirements, including the requirement to demonstrate the Bidder's responsibility under ORS 279C.375(3)(b), and may reject for good cause all Bids after finding that doing so is in the public interest. MW&L also reserves the right to waive informalities in a bid submission if in best interest of McMinnville Water & Light.
