Site work and paving for a road / highway in Williston, Vermont. Completed plans call for site work for a road / highway; and for paving for a road / highway.
The Town of Williston reserves the exclusive right to make changes, substitutions, additions, or reductions in the scope of the proposed work. The bid amount will remain the same with exception of Asphalt Price Adjustment attached. The Town of Williston reserves the right to reject any and all proposals or select the proposal deemed in the best interest of the Town of Williston. The undersigned agrees to the conditions of this proposal and will perform if awarded this contract in accordance with accepted methods and terms of this proposal. The proposed prices accepted shall apply to purchases made between July 1, 2025 and June 30, 2026. The quantities noted for the proposed items are approximate only, being given as the basis for comparison. The Town of Williston reserves the right to increase or decrease the work after acceptance of the proposal during the purchasing period or to reject any or all proposals received, to waive any informalities in the proposals or to accept any proposals should the Town deem it in the best interest of the Town. Contractor's Liability Insurance and Workmen's Compensation in compliance with Vermont Statutory Limits. Contractor's General Public Liability and Property Damage Insurance, including vehiclecoverageissuedtothe Contractor and protecting him from all claims for personal injury, including death, andall claimsfordestruction of or damage to property, arising out of or in connection with any operationsundertheContractDocuments. Whether such operations are by himself or by any Subcontractor under him, or anyonedirectlyemployed by the Contractor or Subcontractor under him. Insurance shall be writtenwithalimitofliabilityof not less than $2,000,000 for all damages arising out of bodily injury, includingdeath, at anytimeresultingthere from sustained by any one person in any one accident, and a limit of not less than$2,000,000aggregatefor any such damages sustained by ten or more persons in any one accident. The Townof Willistonshallbenamed as an additional insured. Mix designs and mix specifications will be determined and approved by the Public Works Director priortolay down and may vary from one work item to another. RAP materials shall not exceed twenty-five percent (25%) in any hot mix application. All overlay and paving 1.5" and over shall be Type 3 mix. Asphalt Price Adjustment 1.1.1. This specification contains price adjustment provisions for asphalt cement used in the production of bituminous concrete pavement. The price adjustment is compensation to the contractor or payment to the Town depending on increase or decrease in the average price of asphalt cementduring the project. 1.1.2. It is understood by the contractor that a price adjustment increasemayrequire the Town to decrease quantities of the pay items inthiscontract inorder to stay within budget. 1.1.3. The contractor hereby agrees that its bid prices for this contract includeno allowances for any contingencies to cover increased costsfor whichadjustment is provided herein. 1.1.4. The contract index price (IP) will be the most recent indexpriceset bythe Vermont Agency of Transportation at the time of Bid Opening. 1.1.5. The posted price (PP) for a ton of asphalt cement will beset monthlybythe Vermont Agency of Transportation. The contract postedpricewill bedetermined by individual roadway as the price in the monththat pavingbegins on that roadway. 1.1.6. A price adjustment will be paid or credited for asphalt cement onlywhenthe Posted Price of asphalt cement increases or decreases over itsrespective Index Price. This price adjustment will be paidonlyif thevariance from the Index Price is 5% of more for a monthly period. Thecomplete adjustment will be paid with no deduction of the5%fromeitherupward or downward adjustments. 1.1.7. The contractor will provide from the supplier the total actual asphalt cement added (tons) per roadway (QAC) based on batchtickets, excludingany percent of asphalt cement from Recycled Asphalt Pavement. 1.1.8. The price adjustment shall be calculated for individual roadwaysandcredited or debited on the final closeout invoice. 1.1.9.
