A. Work under this Contract includes furnishing all labor, materials, services and transportation, except as specifically excluded which is required for completion of Project in accordance with provisions of Contract Documents. B. Work to be included as part of this Contract 1. [ Remove & replace damaged/stained acoustical ceiling tile, paint ceiling grid, paint interior walls, remove and replace ramp decking, skirting & paint railing, skirting, new deck with deck coating, remove old lighting fixtures, replace with new LED lighting, remove and replace t1-11 wall siding and skirtings paint to match existing, supply and install missing window screens, clean bard units and ducting]. C. Related Work 1. Provide all preparation, patching, repairing, reinstallation, and clean up associated with this work to maintain a clean work site. D. Following restrictions apply to access and to use of site and existing buildings: 1. Use of Site: Limit use of premises to Work in areas indicated. Confine operations to areas within Contract limits indicated. Do not disturb portions of site beyond areas in which Work is indicated. Allow for Owner occupancy and use by public. 2. Partial Owner Occupancy: Owner reserves right to occupy and to place and install equipment in completed areas of building before Certified Completion provided such occupancy does not interfere with completion of Work. Such placing of equipment and partial occupancy shall not constitute acceptance of total Work. Pre-bid clarification requests shall be filed no later than February 26, 2025 by Noon. Licenses. Contractors are required to have a Class: B license at the time of bid submission. Each Bid Proposal shall be accompanied by Bid Security in an amount not less than ten percent (10%) of the maximum amount of the Bid Proposal, inclusive of any additive Bid Alternates. Failure of any Bid Proposal to be accompanied by Bid Security in the form and in the amount required shall render such Bid Proposal to be non-responsive and rejected by the District. Bid Proposals shall not be withdrawn by any Bidder for a period of sixty (60) days after the opening of Bid Proposals. During this time, all Bidders shall guarantee prices quoted in their respective Bid Proposals. The date(s) for completion of Milestones and for achieving Substantial Completion of the Work shall be as set forth in the Special Conditions. Failure to complete designated portions of the Work, including Milestones, within the time(s) established in the Special Conditions and/or failure to achieve Substantial Completion of the Work within the Contract Time shall subject the Contractor to Liquidated Damages as set forth in the Special Conditions. Payment and Performance Bonds. A Labor and Materials Payment Bond and Performance Bond are required in the amount of 100% of the Contract amount. The Contractor and all Subcontractors performing any portion of the Work shall pay not less than the applicable prevailing wage rate for the classification of labor provide by their respective workers in prosecution and execution of the Work. Pursuant to Labor Code 1773, the Director of the Department of Industrial Relations of the State of California has determined the generally prevailing rates of wages in the locality in which the Work is to be performed. The Contract for the Work, if awarded, will be by action of the District's Board of Education to the responsible Bidder submitting the lowest priced responsive Bid Proposal. Substitution of eligible and equivalent securities for any monies withheld by the District to ensure the Contractor's performance under the Contract will be permitted at the request and expense of the Contractor and in conformity with Public Contract Code 22300. The Bidder to whom the Contract is awarded shall have thirty (30) days following award of the Contract to such Bidder to submit its written request to the District to permit the substitution of securities for retention. The failure of the Bidder to make such written request to the District within said thirty (30) day period shall be deemed a waiver of the Bidder's rights under Public Contract Code 22300. *The value for this project is based on a financial range. The value is listed as the highest possible cost from the range provided by a stakeholder or official project document.
