A Bid Guaranty shall be submitted with each bid. The Bid Guaranty shall be in the form of either: a. A bond secured by corporate surety in the full amount of the bid guaranteeing that if the bid is accepted, a contract will be entered into and that the performance of same will be properly secured by the bond; or b. A bond secured by cash, certified check, irrevocable letter of credit, or other cash equivalent in the sum of ten (10) percent of the total amount of the bid, guaranteeing that if the bid is accepted, a contract will be entered into by the contractor. If the bidder uses this form of bond, the bidder will be required, as a condition of the contract, to submit a Performance and Payment Bond in the full amount of the contract secured by corporate surety acceptable to the Board of County Commissioners. Bid security may be retained as liquidated damages if the successful Bidder fails to enter into a contract and furnish a bond as specified in the Contract Documents. The County reserves the right to reject any or all bids or to accept any bid which may be deemed to be in the best interest of Butler County, Ohio.
