Bids must be accompanied by a Certified Check, Cashier's Check or Bid Bond drawn to the order of the Pompton Lakes School District for not less than ten percent (10%) of the amount of the bid, but in no case in excess of $20,000.00. The Pompton Lakes School District assumes no responsibility for bids mailed or misdirected in delivery. If the bid exceeds $20,000.00, the bidder must be pre-qualified by the New Jersey Department of Treasury, Division of Property Management & Construction, prior to and on the date that the bids are received. Any bid submitted under the terms of New Jersey statutes not including a copy of the valid and active Prequalification/Classification Certificate will be rejected as being non-responsive to bid requirements. All bidders must be licensed to perform Asbestos Abatement work by the New Jersey administrative/jurisdictional authorities. Bidders are required to comply with the requirements of PL 1975 C (Affirmative Action) N.J.S.A. 10:5-31 et seq., Affirmative Action Against Discrimination and N.J.A.C. 17:27 et seq., PL 1999 Chapter 238 (Public Works Contractor Registration Act), NJSA 10:5-41, New Jersey School Development (SDA) prequalified, and 10:2-1 et seq. and NJSA 34:11-56 (Prevailing Wage rate). American goods and products are to be used where possible (NJSA 18A:18A-20). The Pompton Lakes Board of Education reserves the right to reject any or all bids pursuant to N.J.S.A. 18A:18A-22, those deemed to be non-responsive, and those bids submitted by bidders deemed not to be responsible under the Public-School Contracts Law. The Pompton Lakes Board of Education may also waive any informality in the bidding process in accordance with the law if it is in the best interest of the Board of Education. The contract, if awarded, shall be awarded to the lowest responsible bidder whose bid is responsive in all material respects to the bid requirements. No bid shall be deemed accepted until the adoption of a formal resolution by the Pompton Lakes Board of Education.
