The Contracting Agency is the Swinomish Tribal Community (SITC) and its officers and employees, particularly the Planning and Community Development Department and the Construction Division who are responsible for the administration of the contract. Davis Bacon related Acts and Amendments do not apply, these are general fund hard dollars. Concepts and documents can be viewed on Public Works-Swinomish Indian Tribal Community. Contractors submitting bids pursuant to this RFP shall be required to commit to the execution of a contract for the work prior to the preconstruction meeting and/ or within Thirty (30) days of award notification. Baring normal work stoppages such as weather delays and Holidays. Contractors submitting bids pursuant to this RFP shall be required to commit to the completion of the work on or before the date stated in the "Notice to Proceed". All deliverables and time schedules to be negotiated and agreed upon by all parties OR with all subcontracting companies and SITC prior to issuance of NTP. However, all work Shall be completed substantially by the end of 30 days of work. Every calendar day past 30 days (Possibly negotiated, must meet functionality deadline) that work is not complete the contractor shall pay a 400.00 per day Penalty to SITC excluding weather-related circumstances. Phase 1 of the Air Quality Station will only include the civil work as per the plan set from HLN Engineering. This includes the installation of the the non-red-highlighted gravel road, concrete pad prep for future building, and erosion control. Steel plates are required to cover the road entrance in order to preserve the existing colvert. The gravel road will start at the edge of the right of way line. Approx. 18' from roadway As seen in Attachment F. Fill shall be used and compacted as required by State-wide Urban Design and Specifications (SUDAS), or when so directed by the Project Manager. Each contractor submitting a bid pursuant to this proposal shall be required to commit to and provide to SITC, at the time of the award and execution of the contract, a certificate or certificates of insurance, documenting coverages and in amounts as required by SITC that is attached to this RFP. Retainage of 5% will be withheld until completion of the project.
