Every Tender shall be accompanied by a bid bond, certified cheque payable to the Corporation of the Town of Hearst, or a cash deposit, equal to ten percent (10%) of the Contract Price as described in the Tender. The deposit of the two Tenderers determined by the Owner as representing the best value will be retained until and unless a formal Contract has been executed or the Tender Period has expired, whichever occurs first. All other Tender deposits will be returned to the respective Tenderers within ten (10) days after the Closing Date. The Tender deposit of the successful Tenderer will be returned when he has fully complied with conditions outlined in the Tender Documents. Every Tender shall be accompanied by an "Agreement to Bond" from a Surety Company acceptable to the Owner, which will not be accepted if submitted by facsimile transmission, undertaking to provide a one hundred per cent (100%) Performance Bond and a fifty per cent (50%) Labour and Material Payment Bond, both delivered to the Owner in the event that the Tenderer is awarded the Contract.
