The City of Chesapeake is soliciting proposals from qualified offerors to establish an Indefinite Delivery/Indefinite Quantity contract for Professional Surveying and Drafting Services that includes the following: (a) land surveying services (b) digital drafting services (c) utility locating and (d) utility designation services. The City intends to select multiple firms for use on various projects. The City of Chesapeake does not discriminate against faith-based organizations in accordance with Code of Virginia Section 2.2-4343.1 or against any contractor, bid, or offeror because of race, religion, color, sex, national origin, age, disability, or any other basis prohibited by State law relating to discrimination in employment. Scope of Services The City requires professional surveying and drafting services on City roadway, utility, drainage and property boundary, and subdivision projects. The services must provide complete surveying information for use preparing plats and plans on projects selected by the City. All work must be completed within the agreed schedule for each individual project work order. Surveying work shall be performed by or under the direct supervision of a surveyor who is licensed in Virginia as a Land Surveyor. The City's requirements include obtaining survey data, preparing property plats or engineering plans, designating and locating subsurface utilities and preparing test hole reports during the engineering design phase of Capital Improvement and minor work projects. To this end, the City is requesting proposals to perform the following work on an annual (as needed) basis. 3.3. Basic Services of Surveyor BASIC SERVICES The Surveyor shall perform professional surveying/drafting services as hereinafter stated which includes normal surveying services incidental thereto and as required for project construction. The Surveyor represents that they will perform all tasks in accordance with generally accepted professional standards and the Surveyor further represents that they will provide the City the best possible advice and consultation within the Surveyors authority and capacity as a licensed surveyor. The Surveyor will comply with the regulations, laws, ordinances, and requirements of all governmental environmental impact statements applicable to the project. STUDY AND DESIGN PHASE Prior to issuance of an individual Work Order the consultant shall: Meet with City personnel to outline a scope of services, establish time constraints, prepare rough outline of plan sheets required and to review available plans and data. After determining a scope of services, and if it is determined that the work can be performed successfully, in a timely manner, and at a total cost negotiated (consistent with the fee schedule included in the base contract) and considered to be fair and reasonable, the consultant will be assigned the project and an individual work order be issued. If a fee cannot be negotiated with the consultant or the City elects to bid a contract specific to a particular project, then discussions will be terminated and alternative procurement methods will be conducted. Representative projects typically include all necessary research, field, and survey/drafting work. On most projects, the consultant will be required to prepare preliminary survey/drafting documents and/or draft study. Based on the information contained in the preliminary survey/drafting documents, the consultant will be expected to submit an opinion of the estimated project cost including, but not limited to survey/drafting costs, construction staking costs and contingencies. The consultant will be expected to meet with City representatives and review the preliminary design/study. The consultant shall furnish all such documents, plans and design data as may be required for, and to assist the City in the preparation of the documents for submittal to the appropriate local, State, or Federal agency. The consultant shall attend and participate in meetings and hearings as authorized by the City. If permission to enter private property cannot be obtained from a private landowner by the consultant, the consultant prior to sending a final request to enter the premises inclusive of dates of inspection, identifying the participating entities, and such other information required by Va. Code Section 25.1-203 shall consult with the City's project manager assigned to a particular project to see if such notice can be combined with any other entry of the property needed by City staff or additional consultants. C. FINAL DESIGN PHASE Upon completion of the Preliminary Design Phase and notification from the Owner that the preliminary design documents are acceptable, the consultant shall: Prepare the final construction plans and specifications, right of way/easement plats, Contract Documents, and assist in the preparation of associated documents. It is expected that each project will have a 30%, 60%, 90%, and 100% and final submittal. Furnish all such documents, plans, studies, and design data as may be required and assist in the preparation of any required documents so that City may obtain approval from appropriate local, State, or Federal agencies. The consultant shall attend and participate in administrative hearings and meetings as authorized by City. Furnish a revised estimate of project costs based on the final plans and specifications and other related documents. Prepare revisions/addendum as required. D. CONSTRUCTION PHASE The consultant may be responsible for providing control staking, easement and right-of-way staking, and general consultation during the construction phase and litigation phases. Control staking may include setting iron pins at property corners (including easements), providing one or more elevation benchmarks at the site and providing centerline offset stakes for water and sewer main construction. Detailed daily inspections of the construction work will generally be performed by the City. The consultant's responsibilities during the construction phase may include but not be limited to the following: Furnish the City and the contractor with additional sets of plans and specifications as needed. Consult with and advise the City on matters relating to the construction activities. Provide a set of record drawings to the City in electronic format. 12. Period of Performance The resulting contract shall be for a period of Two (2) years from the date of execution and may be extended prior to expiration for three (3) One-Year optional renewal years upon mutual written agreement of the parties. 15.1. CLARIFICATION OF TERMS If any bidder/offeror has questions about the specifications or other solicitation documents, the bidder/offeror should contact the buyer whose name appears on the face of the solicitation no later than 5 working days before the due date. Any revisions to the solicitation will be made only by addendum issued by the City. 15.2. MANDATORY USE OF CITY FORM Failure to submit a bid on the official City form provided for that purpose shall be a cause for rejection of the proposal. Modification of or additions to any portion of the proposal may be cause for rejection of the proposal; however, the City reserves the right to decide on a case by case basis, in its sole discretion, whether to reject such a proposal as nonresponsive. As a precondition to its acceptance, the City may, in its sole discretion, request that the offeror withdraw or modify nonresponsive portions of a proposal which do not affect quality, quantity, price, or delivery. No modification of or addition to the provisions of the contract shall be effective unless reduced to writing and signed by the parties. 15.3. ANTITRUST By entering into a contract, the Consultant conveys, sells, assigns, and transfers to the City of Chesapeake all rights, title and interest in and to all causes of action it may now have or hereafter acquire under the antitrust laws of the United States and the Commonwealth of Virginia, relating to the particular services acquired by the City of Chesapeake under said contract. 15.4. DEBARMENT STATUS By submitting their bids/proposals, bidders/offerors certify that they are not currently debarred by the Commonwealth of Virginia or any political subdivision or agency of the Commonwealth from submitting bids/proposals on contracts for the type of services covered by this solicitation, nor are they an agent of any person or entity that is currently so debarred. 15.12. NO WAIVER OF LEGAL RIGHTS Neither the acceptance by the City or any representative of the City, nor any payment for or acceptance of the whole or any part of the Work, nor any extension of time, nor any possession taken by the City shall operate as a waiver of any portion of the Contract or of any power herein reserved or of any right to damages. A waiver of any breach of the Contract shall not be held to be a waiver of or implied course of dealing applicable to any other or subsequent breach. The City reserves all rights, privileges, immunities and defenses available to it at law. 15.15. TESTING AND INSPECTION The City reserves the right to conduct any test or inspection it may deem advisable to assure goods and services conform to the specifications. 15.16. ASSIGNMENT OF CONTRACT A contract shall not be assignable by the Consultant in whole or in part without the written consent of the City. The method of Contractor Selection has not been Determined at this time.
