The Heritage Palms Community Development District (HPCDD) is a local unit of special purpose government established in accordance with Chapter 190, Florida Statutes. The district is requesting proposals for the following: HPCDD Mill and Repave Wine Palm Road and Seminole Palm Way. To be eligible to submit a bid, and in addition to any other requirements set forth in the RFP, an interested firm must (i) hold all required local, state and federal licenses in good standing and be authorized to do business in the City of Fort Myers, Lee County and the State of Florida, and (ii) be able to furnish a bond or other form of security in the amount of the Project to the HPCDD. TIME IS OF THE ESSENCE WITH RESPECT TO THE PROJECT. Receipt of a response by any person or officer of HPCDD other than the District Manager does not constitute "receipt" as required by this solicitation. Envelope Must Be Identified as Sealed Proposal for: HPCDD Mill and Repave Wine Palm Road and Seminole Palm Way RFP # HPCDD-2025-01 to Be Opened. Electronic proposals can be submitted with a statement that the company is submitting the proposal online and that the Vendor understands that the proposal will be printed by the District Manager and placed in an envelope prior to the deadline. Any proposals submitted online will be read first prior to any submitted by mail or hand delivered. NO proposals will be accepted online, by mail or other delivery after the bid opening deadline. Each Proposal shall remain binding for a minimum of ninety (90) days after the Bid opening. The successful Proposer will be required to furnish and pay for a Certificate of Insurance, a Performance and Payment Bond for one hundred percent (100%) of the value of the contract (as described in the Bid Documents), with a surety acceptable to the HPCDD, and in accordance with Section 255.05, Florida Statutes, and otherwise meet the other requirements set forth in the Contract Documents. All bid bonds, contract bonds, insurance contracts and Certificates of Insurance shall be either executed by or countersigned by a licensed resident agent of the surety or insurance company having its place of business in the State of Florida, and in all ways complying with the insurance laws of the State of Florida. Further, the said surety or insurance company shall be duly licensed and qualified to do business in the State of Florida. Proposals will be evaluated in accordance with the criteria included in the Bid Documents. The HPCDD reserves the right to reject any and all proposals, make modifications to the work, award the contract in whole or in part with or without cause, and waive minor or technical irregularities in any proposal, as it deems appropriate, and if the HPCDD determines in its discretion that it is in the HPCDDs best interests to do so. Any person who wishes to protest the bid documents, including but not limited to the terms and specifications, or any component thereof, must file with the HPCDD a written notice of protest within seventy-two (72) calendar hours (excluding Saturdays, Sundays, and state holidays) after the publication of said bid documents, together with a protest bond in a form acceptable to the HPCCD and in the amount of $50,000. In the event the protest is successful, the protest bond shall be refunded to the protestor. In the event the protest is unsuccessful, the protest bond shall be applied towards the HPCDDs costs, expenses and attorneys fees associated with hearing and defending the protest. Failure to timely file a protest, or failure to timely post a protest bond, will result in a waiver of proceedings under Chapter 190, Florida Statutes, and other law. Additional requirements for filing a protest can be found in the HPCDDs Rules of Procedure, if any, which are available upon request. HPCDD reserves the right to accept or reject any or all Bids (in whole or in part) with or without cause, to waive any technicalities, irregularities or formalities, or to accept the Bid(s) that in its judgment best serves HPCDD.
