The initial contract term is one (1) year and shall become effective upon contract award. Contract award will be made by the issuance of a Notice of Award document via the Newton County School System. The Award will be made to the lowest responsive and responsible bidder(s). It is the intent of the School System to award to a single vendor; however, the School System may, at its discretion, award the bid to a single vendor, multiple vendors, by category or by line item if it is in its best interest to do so. Award will be based on total cost provided in the last column of the Bid Submission Form Spreadsheet. In lieu of canceling the purchase order, the School System, may levy a charge for each day beyond the required completion date that the successful Bidder fails to complete the services or deliver the required goods. Such charges are not a penalty, rather it is the agreed upon liquidated damages representing the estimated damages that will be incurred by the School System as a result of the Vendor's failure to complete the services and/or deliver the goods as required. Partial completion on a purchase order will not exempt a Vendor from this charge. Further, the School System has the right after assessing such charge, and after the continuing failure of the Vendor to make complete, to terminate the purchase order, or pursue any other legal remedies allowed by State or Federal laws and regulations. Vendor shall procure and maintain a Commercial General Liability Insurance Policy, including products and completed operations liability, and contractual liability coverage covering bodily injury, property damage liability and personal injury. The policy or policies must be on an "occurrence" basis unless waived by the school system. The policy shall include contractual liability coverage. The policy purchased by the Vendor must be issued by a company authorized to conduct business in the State of Georgia or by a company acceptable to the school system. The policy must include separate aggregate limits per project. Excess liability coverage may be used in combination with the base policy to obtain the limits listed below. Limits $500,000 per Person $1,000,000 per Occurrence The School System reserves the right to accept or reject and any items that are bid as alternates where allowable.
