Each Bid or Proposal must be accompanied by a cashiers check, certified check, or Bid Bond payable to The City of Missoula in the amount of not less than ten percent (10%) of the total amount of the bid and must be in the form specified in MCA 18-1-201 through 206. The bid bond or other security shall protect and indemnify City of Missoula against the failure or refusal of the bidder to enter into the contract within 30 days of bid acceptance. Bid security will be returned to the unsuccessful bidders as soon as practicable after the opening of the bids. Successful bidders shall furnish an approved performance bond and a labor and materials payment bond, each in the amount of one hundred percent (100%) of the contract amount. Insurance as required shall be provided by the successful bidder(s) and a certificate(s) of that insurance shall be provided. The City of Missoula reserves the right to waive informalities, to accept the lowest responsive and responsible bid, which is in the best interest of the owner, to reject any and all proposals received, and, if all bids are rejected, to re-advertise under the same or new specifications, or to make such an award, as in the judgment of its officials, best meets the owner s requirements. The contractor is required to be an equal opportunity employer. The Contract Will Be Awarded to the Lowest Responsible Qualified Bidder Whose Bid Proposal Complies With All the Requirements. The envelopes shall also be marked with the Bidder s Name, Address and Montana Contractor's Registration Number and indicate receipt of any addendums issued.
