The City of Newport reserves the right to reject any or all proposals or to accept any proposals deemed to be for the best interest of the City. A. Unless otherwise specified, for lump sum items, payment will be made as set forth in the Agreement on the basis of actual Work completed in accordance with the Contractor-submitted Schedule of Values and agreed to by Engineer. The word "Engineer" shall mean the Director of Public Services whether acting directly or through properly authorized agents, inspectors or representatives of the Engineer, acting within the scope of duties entrusted to them. D. The word "Contractor" shall mean the "Party of the Second Part," of this Contract, or his or their duly authorized agents. E. The word "Contractors Engineer" or "Designer" shall mean the third-party engineer authorized by Contractor to perform designer services.
