Online Q&A No Scope of Services The City of Pomona is soliciting sealed bids from qualified companies for the will call purchase of various grades of asphalt concrete material as specified herein. Other Details A City of Pomona Business License is required, as well as, valid general liability and vehicle insurance, when (and if) delivering within City limits.Bid Validity: Bids shall be valid for minimum of 180 days after the published Bid due date.RESERVATION OF RIGHTS AND REJECTION OF BIDSThis solicitation does not commit the City to award a contract. The City reserves the right at its sole discretion to:1. Reject responses received after the due date and time specified. The City will not return late submittals. Late submittals will be destroyed by the City 30 days after opening.2. Cancel the entire solicitation at any time time, and re-advertise when determined to be in the City’s best interest.3. Accept or reject any and all submittals, waive any minor errors, informalities, and procedures without penalty to the extent permitted by law.4. Be the final judge as to which response is the most qualified.5. Consider any of the following as non-responsive and subject to rejection for this solicitation:a. Responses from Respondent that are not registered as a prospective bidder in PlanetBids for the City of Pomona for this specific solicitation;b. Responses containing items not specified;c. Responses containing incorrect items;d. Responses that do not respond to items in the manner specified;e. Responses received by in person, telephone, email or facsimile;f. Responses that fail to specifically provide the information requested; and g. Responses otherwise not compliant with the instructions and requirements. Notes CONTRACT TERM The City is asking for fixed prices for one (1) year, commencing from the date of Council award, with the option to renew for up to four (4) additional years, in one (1) year increments. The prices shall be in effect for a one (1) year period. Sixty (60) days prior to the end of the annual contract expiration date, the Vendor may request a price adjustment, which must be submitted to the Purchasing Manager in writing for review and approval. The price increase or decrease must be in accordance with the Yearly Consumer Price Index for All Urban Consumers the Los Angeles/Long Beach/Anaheim Metropolitan Statistical Area issued by the U.S. Department of Labor. Special Notices Local Programs & Policies Please note that per Section 2-971(2) of the Pomona City Code, any unauthorized contact by the bidder during the bid or proposal process with an official or city employee, other than those shown on the RFP or bid, the Finance Director, or Purchasing Manager, shall cause the bidder to be immediately disqualified from participating in the bidding process.
