The work to be performed under the provisions of these contract documents consists of furnishing all materials, equipment, labor, and installation required to construct asphalt trail, drainage, earthwork, pedestrian bridge, and associated appurtenances, as shown on the Drawings and specified herein. Arkansas State Contractor Licensing Law applies, and subcontractors also need to be licensed. Licensure is not required for bid submission but must be provided prior to signing the contract. Each bid must be accompanied by a certified or cashier's check, or acceptable bid bond, in an amount not less than five percent of the total bid as a guaranty. The successful bidder will be required to furnish a Performance and Payment Bond, each in the amount of the contract, written by a responsible surety company authorized to do business in Arkansas. No bid may be withdrawn for at least thirty calendar days after the scheduled closing time. The owner reserves the right to consider the most advantageous construction in case of ambiguity, and to reject any or all bids, waive informalities, and award the contract deemed most in the owner's interest. Qualified bids may be subject to rejection. Any subcontractors must be acceptable to the owner. The contract is subject to applicable labor laws, non-discrimination provisions, wage rate laws, and other federal laws including the Fair Labor Standards Act of 1938, the Work Hours Act of 1962, and Title VI of the Civil Rights Act of 1964. Any person contemplating the submission of a Bid shall have thoroughly examined all of the various parts of these Documents, and should there be any doubt as to the meaning or intent of said Contract Documents, the Bidder should request of the Engineer, in writing (received by the Engineer at least 5 working days prior to bid opening) and interpretation thereof.
