A performance bond at 100 percent of the Construction Contract(s) amount, conditioned upon the faithful performance of the Construction Contract(s) in accordance with the plans, specifications, and conditions of the contract. Such bond shall be solely for the protection of the contracting body which awarded the Construction Contract(s). Protection of claimants supplying labor or materials. A payment bond at 100 percent of the Construction Contract(s) amount. Such bond shall be solely for the protection of claimants supplying labor or materials to the Company, or to any of its subcontractors, in the prosecution of the work provided for in such Construction Contract(s), and shall be conditioned for the prompt payment of all such material furnished or labor supplied or performed in the prosecution of the work. "Labor or materials" shall include public utility services and reasonable rentals of equipment, but only for periods when the equipment rented is actually used at the site. The City shall have unrestricted authority to reproduce, distribute, and use any submitted report, data, or material, and any software or modifications and any associated documentation that is designed or developed and delivered to the City as part of the performance of the Contract. The City reserves the right to reject any or all proposals and the City is not bound to accept any proposal if that proposal is contrary to the best interest of the City of York.
