The Contractor must ensure that the DBE subcontractor(s) is performing a "commercially useful function" as defined in CFR 26.55. Bidders must be prequalified with the Ohio Department of Transportation. Bidders must apply for prequalification with the department at least 30 days (for joint ventures, 5 days if both are currently pre-qualified) before the date set to open bids. Except as provided in Section 102.07 of the CMS, each bid must be accompanied by a certified check in the sum of 5% of bids on a solvent bank, or a bid bond in like amount, acceptable to the City of Akron, as a guarantee, that if the bid is accepted, a contract will be entered into. Except as provided in Section 103.05 of the CMS, and as required by the Ohio Department of Transportation, the bidder to whom the contract is awarded will be required to furnish a bond in the sum of 100% of contract price for the faithful performance of the contract.
