Scope of Work The contract work for this project shall consist of the removal of existing court striping and repair, leveling, surfacing, and striping of basketball courts and pickleball courts. This work will be performed in strict conformance with the Contract Documents, permits from regulatory agencies with jurisdiction, and applicable regulations. The quantity of Work to be performed and materials to be furnished are approximations only, being given as a basis for the comparison of Bids. Actual quantities of Work to be performed may vary at the discretion of the City Engineer. Liquidated Damages There will be a Five Hundred Dollar ($500.00) assessment for each calendar day that work remains incomplete beyond the time stated in the Proposal Form. Refer to the Proposal Form for specific details. Department of Industrial Relations For all bid proposals submitted on or after March 1, 2015, Labor Code Section 1725.5 requires all contractors and subcontractors to annually register with the Department of Industrial Relations (DIR) before bidding on or performing any public works contract. A contractor or subcontractor will need to be registered with the DIR in order to be qualified to bid on, be listed in a bid proposal as a subcontractor, or engage in any component of the work for a public works contract. Proof of current registration with DIR for the prime contractor and all listed subcontractors must be Prevailing Wages In accordance with the provisions of Section 1770 and 1771 et. seq., of the Labor Code, the Director of Industrial Relations of the State of California has determined the general prevailing rate of wages applicable to the work to be done. The Contractor and any subcontractor under the Contractor shall comply with the requirements of said sections in the employment of apprentices. Information relative to apprenticeship standards and administration of the apprenticeship program may be obtained from the Director of Industrial Relations, San Francisco, California, or from the Division of Apprenticeship Standards and its branch offices. Payroll Records The Contractor's attention is directed to Section 1776 of the Labor Code, relating to accurate payroll records, which impose responsibility upon the Contractor for the maintenance, certification, and availability for inspection of such records for all persons employed by the Contractor or by the subcontractors in connection with the project. The Contractor shall agree through the Contract to comply with this Section and the remaining provisions of the Labor Code. Insurance Requirements The Contractor shall provide insurance in accordance with these Specifications. The Contractor will be required to pay to all workers on the project sums not less than the sums set forth in the documents entitled "General Prevailing Wage Determination made by the Director of Industrial Relations pursuant to California Labor Code Part 7, Chapter 1, Article 2, Sections 1770, 1773, 1773.1". In addition, the Contractor shall guarantee all work against defective workmanship and materials furnished by the Contractor for a period of one (1) year from the date the work was completed in accordance with Sections 2-4 and 6-8 of the Standard Specifications for the Public Works Construction. The CITY reserves the right to reject any or all bids, award each item separately, and/or waive any informality on any bid. No bid may be withdrawn for sixty (60) days after the time set for the opening thereof. Failure by the successful bidder to enter into a contract with the CITY or to deliver goods and/or services in accordance with the bid may result in a declaration by the CITY that the bidder is not a responsible bidder and elimination from consideration in future bidding. At the time of contract award, the prime contractor shall possess the appropriate contractor's license and/or any combination of specialty contractor's license(s) sufficient to perform the work.
