Modular Building Design and Construction for Bailey Elementary School Bid Bond will not be required. Performance Bond in the amount of one hundred percent (100%) of the contract sum to insure Lease Leaseback Contractor and Owner during construction and for one year, or longer as required by warranty periods, after completion against faulty or improper materials or workmanship and to assure Lease Leaseback Contractor and Owner of full and prompt performance of the contract. Payment Bond (Labor and Material) in the amount of one hundred percent (100%) of the contract sum in accordance with the laws of the State of California to secure payment of any and all claims for labor and materials used or consumed in performance of this contract. Time is of the essence in this contract, and the duration for this project shall be as noted in the Ownerís Notice to Proceed. All durations, activities and sequences for the subcontractors shall be performed as shown in the Construction Bid Schedule to be published as part of the next addendum, and as modified by a monthly schedule update, if any The Subcontractor shall be required to satisfy the conditions set forth in the contract and Education Code section 45125.2 regarding fingerprinting requirements and student safety prior to permitting any contact with students. Upon award of the contract and before beginning work, the Subcontractor shall be required to provide a verification of compliance with the student safety provisions of the contract and Education Code section 45125.2. Proposals may be withdrawn by the bidder prior to the time fixed for the submittal of bids. Upon award of the bid, require signature on the enclosed declaration to ensure compliance with the general Conditions and the Education Code. The Owner reserves the right to waive any irregularity and to reject any or all bids. The District and David A. Bush, Inc. do not discriminate on the basis of race, color, national origin, religion, age, ancestry, medical condition, disability, gender, or any other protected class, in consideration for an award of contract. Rejection of any or all proposals, to contract work with whomever and in whatever manner, to abandon work entirely, and/or to waive any informality in receiving of bids is reserved as the right of the Owner and Lease Leaseback Contractor. Before the contract or contracts are awarded, the Owner or Lease Leaseback Contractor may at its sole discretion require from the proposed Subcontractor on each project further evidence of the reasonable qualifications of such Subcontractor to faithfully, capably, and reasonably perform such proposed contract and may consider such evidence before making its decision on the award of such proposed contract. The Contract shall be signed by the successful bidder in as many originals as David A. Bush, Inc. deems necessary and returned, together with the contract bonds and insurance certificates, within ten (10) days after the bidder has received notice that the contract has been awarded.
