All sealed proposals must be clearly marked Submission Offerors shall submit a proposal bond by an acceptable surety in the amount of five percent (5%) of the proposal in excess of $100,000.00. A certified check or bank draft payable to the locality or negotiable U.S. Government Bonds (as par value) may be submitted in lieu of the Proposal BA certified check or bank draft payable to the locality or negotiable U.S. Government Bonds (as par value) may be submitted in lieu of the Proposal Bond. The successful Offeror must be able to furnish a Performance and Payment Bond each in the amount of 100% of the contract price from an approved Surety Company holding a permit from the State of Texas to act as Surety and acceptable according to the latest list of companies holding certificates of authority from the Secretary of Treasury of the United States, or other Surety or Sureties acceptable to the Owner. Awarded contractor shall be required to furnish bonds within thirty (30) days from the contract date and before any commencement of work. Val Verde County Commissioner's Court reserves the right to reject or to waive any and all irregularities or informalities in the proposal. Proposals may be held by Val Verde County for a period of sixty (60) days or until a contract is awarded, whichever occurs first, from the date of the RFP opening for the purpose of reviewing proposals. All contractors/subcontractors that are debarred, suspended, or otherwise excluded from or ineligible for participation may not undertake any activity in part or in full under this project.
