The New Haven Unified School District is seeking Bids for the Exterior Painting and Gutter Replacements Project at Cesar Chavez Middle School. The work includes but is not limited to lead abatement (if any), campus wide dry rot repair, gutter replacements and painting of all previously painted surfaces. Failure of any Bid Proposal to be accompanied by Bid Security in the form and in the amount required shall render such Bid Proposal to be non-responsive and rejected by the District. Pursuant to sections 1770 et seq. of the California Labor Code, Bidder and all Subcontractors under the Bidder shall pay all workers on all work performed pursuant to the Contract not less than the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work as determined by the Director of the State of California Department of Industrial Relations (DIR) for the type of work performed and the locality in which the work is to be performed within the boundaries of the District. In accordance with the provisions of California Public Contract Code 3300, the District requires that Bidders possess the following classification(s) of California Contractors License at the time that the Bid Proposals are opened: Class B, General Contractor with Asbestos and Lead Certification or Sub-Contractor with Asbestos and Lead Certification performing the work. Any Bidder not so duly and properly licensed shall be subject to all penalties imposed by law. Bid Proposals shall not be withdrawn by any Bidder for a period of ninety (90) days after the opening of Bid Proposals. During this time, all Bidders shall guarantee prices quoted in their respective Bid Proposals. The District reserves the right to reject any or all Bid Proposals or to waive any irregularities or informalities in any Bid Proposal or in the bidding. The District has a Disabled Veteran Business Enterprise (DVBE) Participation Goal Program ("the DVBE Program") which establishes a three percent (3%) Participation Goal for DVBEs. All Bidders are required by the District, pursuant to the DVBE Program, to submit DVBE Worksheets that confirm two (2) advertisements were published at least 14 days prior to bid opening. The Contract for the Work, if awarded, will be by action of the District's Board of Education to the responsible Bidder who submitted the lowest priced responsive Total Base Bid Proposal. The District reserves the right to reject any or all Bid Proposals or to waive any irregularities or informalities in any Bid Proposal or in the bidding. Beneficial Occupancy: Tuesday, September 30, 2025 . If the bid for the Project requires an additional form of security to insure compliance with the requirements of this Agreement for guarantees and warranties, the Contractor shall provide, at its sole cost and expense, a maintenance-warrantyguaranty bond for a sum equal to the lesser of (x) ten percent (10%) of the Contract Sum, and (y) One Million Dollars ($1,000,000) (the "Maintenance Bond"). Such Maintenance Bond will be issued by a Surety meeting the requirements of this Contract. The Maintenance Bond shall cover the entire scope of the Work, shall be in addition to any and all warranties or guaranties issued by manufacturers and suppliers, and shall warrant and guaranty all of the Work for a term equal to the terms of each of the Contractor's warranties and guaranties provided in the Contract Documents so that the Maintenance Bond will fully warrant and guaranty each Contractor warranty and guaranty set forth in the Contract Documents for an equal amount of time as set forth in the Contract Documents. The Maintenance Bond shall further warrant and guaranty a response time of not more than one (1) business day from the time of District's notification to the Contractor of a defect. If the Contractor fails to respond and/or initiate any action for the repair of defects within a period of one (1) business day after notice from the District thereof, the District shall then have the right to summarily execute upon the Maintenance Bond up to its entire value and proceed to remedy and correct the defect without further notice to Contractor.
